Duncan CUP #04-99 Page 2 April 21, 1999 Planning and Zoning: This Conditional Use Permit application is in response to a zoning violation complaint that staff received. The applicant was cited for the operation of an illegal business (antique restoration), and obtaining the CUP is an available option to resolve the violation. The Zoning Ordinance allows for Cottage Occupations with a Conditional Use Permit in the RA (Rural Areas) Zoning District. This property is located in the RA district, and the antique restoration business would qualify as a cottage occupation. In adherence to the cottage occupation definition, all activities would be. required to occur within structures. Therefore, it appears this proposed use would not have any significant impacts on the adjoining properties. STAFF RECOMMENDATION FOR THE 4/07/99 PLANNING COMMISSION MEETING: Staff feels that the application is in conformance with the surrounding areas, and would recommend approval of this application with the following conditions: 1. All review agency comments shall be complied with at all times. 2. All work shall be accomplished inside of the completely enclosed building. 3. PLANNING COMMISSION SUMMARY & ACTION OF 04/07/99: The applicant explained his antique restoration operation to the Commission, specifically, the hours he works, the equipment and chemicals he uses, and the individual steps used in the process to restore his furniture. The applicant stated that he strips furniture by hand one day per week; he has no dipping tanks or systems of any sort. He does not discard any stripper onto grass or driveway, and there are no pools of chemicals on the floor of the garage. He uses a hand sander with a dust collector. He said that finishing is done with a spray can one time per week; he uses no compressors or spray guns. The applicant said that a 1,200 c.f.m. exhaust fan was recently installed in the back wall of the garage. The adjoining property owner stated that she has an intolerance to fumes and aerosols and experiences severe allergic reactions when the applicant is working in his shop; she was opposed to the Cottage Occupation. She stated that she has installed exhaust systems in her home and wears a face mask outdoors. The adjoining property owner's two daughters, who were also present to speak in opposition, said that their mother's allergic reactions to the fumes are disruptive to her quality of Stephen W. They stated that the fumes get trapped in their mother's house and they have personally experienced the fumes when they visit her. They presented a letter from Dr. Paul K. Stillwagon of the Asthma & Allergy Center of the Northern Shenandoah Valley, Inc. to the doctors at Amherst Family Practice concerning their mother's condition. They also presented various OSHA Hazard Information Bulletins regarding chemicals used in furniture restoration. A member of the Commission stated that he has never met the applicant, but drives by the applicant's property every day. He stated that the garage door is always closed and everything is neat and so well -kept that he did not realize that the applicant worked inside of the garage all day. He stated that he has never seen a piece of furniture out in the yard, nor has he seen him working in the garage with the door up. This Commissioner said that he drives by with his windows down and has never smelled fumes of any sort. Other Commission members sympathized with the adjoiner's problems, but were not convinced that her allergic reactions were a result of the work being done by the applicant due to the low volume of activity and carrying out the work by hand, i.e.: without the use of dipping tanks, spray guns, or a compressor. Furthermore, it was noted that the chemicals used in the process evaporate into the atmosphere; they do not locate close to the ground where they could seep into a building. Since the adjoiner did not undergo any immunology testing, Commission members were hesitant about drawing conclusions regarding the cause of her reported symptoms. Seeger D.O.B.: 2-7-30 Your patient, 69 year Evelyn Seeger, was seen on 3-31-99 for evaluation of presumed reactions to airborne fumes, Mrs. Seeger reports an 8-month history of recurring episodes of dry mouth, numbness of the lips, palpitations, and generalized shakiness in association with exposure to fumes from a next door neighbor's furniture refinishing business. She indicates that the building where this refinishing takes place is approximately 30 feet from her home. These symptoms do not occur when she is away from home or when the refinishing process is not in progress. . Mrs. Seeger notes a prior history of intolerance to fumes and aerosols but never to this degree of severity. The reactions are disruptive to her quality of life and overall sense of well-being. She does not seem to experience much in the way of cough, wheezing, or significant respiratory symptoms with exposure to these fumes. Ner health is otherwise unremarkable. Physical examination today was essentially within normal limits, Peak expiratory flow rate was normal at 400 liters per minute. Allergy testing was not felt to be indicated as it is of no value in evaluating sensitivities to airborne irritants. It is my impression that Mrs.. Seeger has a chemical intolerance to petroleum based spirits that are likely being used in the process of her neighbor's furniture refinishing business. She has no knowledge of the specific products that are being used, and I think it would be very useful to be able to see material safety data sheets for all of these products. These safety data sheets indicate the likelihood of a person experiencing all adverse reaction to any chemicals contained in a given product. In summary, we have a woman who has a super sensitivity to fumes from what are probably petroleum based spirits whose home happens to be adjacent to someone who is using these products on a regular basis. The only long term beneficial treatment for Mrs. Seeger is to avoid exposure to these airborne irritants. Should you have any questions, please do not hesitate to contact me. ACTION: Final rule. SUMMARY: The Occupational Safety and Health Administration (OSHA) hereby amends its existing regulations for employee exposure to methylene chloride (MC), (also known as methylene dichloride, dichloromethane or DCM). OSHA has determined, based on animal and human data, that the current permissible exposure limits (PELs) allow employee exposure to a significant risk of material impairment of health. OSHA is reducing the existing 8-hour time -weighted average (TWA) exposure from 500 parts MC per million parts (ppm) of air to 25 ppm. Also, OSHA is deleting the existing ceiling limit concentration of 1,000 ppm and is reducing the existing short-term exposure limit from 2,000 ppm (measured over five minutes in any 2 hour period) to 125 ppm, measured as a 15-minute TWA. In addition, the Agency is setting an "action level" of 12.5 ppm, measured as an 8-hour TWA. The final rule also contains provisions for exposure control, personal protective equipment, employee exposure monitoring, training, medical surveillance, hazard communication, regulated areas, and recordkeeping. Together, these provisions will substantially reduce significant risk to the extent feasible. This standard applies to all employment in general industry, shipyards and construction. Small employers, for purposes of the Regulatory Flexibility Act, 5 U.S.C. 601, are defined as firms with fewer than twenty employees. The final standard will prevent an estimated 31 cancer deaths per year and an estimated three deaths per year from acute central nervous system and carboxyhemoglobinemic effects, and will also reduce cardiovascular disease and material impairment of the central nervous system. The estimated cost, on an annualized basis, is $101 million per year. DATES: This final rule becomes effective April 10, 1997. It has been reported by Region V that recent climatic conditions have contributed to the need for increased fumigation of stored grain due to an upsurge in insect infestations and that economic developments have led to the increased movement of stored grain. Fumigants commonly used for insect control on stored grain include methyl bromide, phosphine (also known as Phostoxin, "L-fume or aluminum phosphide) and mixtures of carbon tetrachloride and carbon disulfide. None of these has adequate warning properties, yet their toxic effects can include permanent central nervous system damage, heart and vascular disease and lung edema as well as cancer. The increased use of these fumigants and increases in the handling of fumigated grain, coupled with the insidious nature of these toxicants makes it imperative that employers take special care in the evaluation of their grain handling facilities and transit carriers (e.g., truck trailer, railroad cars and barges) via quantitative test methods common to industrial hygiene practice for the protection of affected employees. Pagel of 2 What You'll Need How Much Stripper to Buy The amount of paint remover you will need depends on what you are stripping and how many coats of old surface must be removed. In general one gallon of remover will strip 75 to 100 square feet. A chair or small end table with a clear finish on it will require about one quart. A dining room table with a clear finish will probably require two quarts. Try to buy only what you will use to avoid storing paint -removing chemicals in the home. Materials To Do The Job • Paint Brush. An old, wide one will do. Natural -bristle will last longer than synthetic. • Scraper. A dull, flexible -blade putty knife is best. If necessary, dull the cutting edge and corners of the blade with a metal file; otherwise, you might gouge the wood. • Toothbrush, ice pick, cotton swabs. Handy for getting into tiny crevices or intricate designs in the wood. • Steel Wool pads (#2). Helpful for removing the stripper or old finish from pores in open -grained woods such as walnut, oak, or mahogany. Also, can be used to prepare the surface for a new finish. • Metal cans. (eg. large coffee cans) Good for holding the paint remover while work is in process, and for collecting the waste (sludge) when the work is done.. Make sure the container you use has a securely fitting lid. • Burlap, twine, or coarse string. Handy for removing paint from leg turnings (using shoe shine or back -and -forth rubbing motion). • Stiff -bristle scrub brush. Useful for removing the old paint from places inaccessible to a scraper. • Disposable pie pans or some other suitable container. Place under the legs of the furniture to catch drippings. • Dropcloth, newspapers, cardboard, and old rags. To catch drippings and sludge to protect the surface underneath the work. Paint removers can damage linoleum, asphalt, plastic, and vinyl. Protective Equipment • Safety goggles. To completely cover and protect the eyes. Rubber gloves. Not the dish -washing kind. Should be chemical -resistant, such as neoprene or butyl. SETTING UP YOUR WORK SITE Setting Up Your Work Site Selecting a Work Site Page 1 of 1 am age • The single most important consideration is the availability of fresh air. The best location is outdoors, preferably in a shaded area, a carport, or under some type of cover to shield the work from the sun. The sun will speed up the evaporation of the remover. A garage with windows and doors on two sides to create adequate cross ventilation also can be used. Avoid working indoors if at all possible. • If you must work indoors, open all windows and, if possible, all doors to achieve a strong flow of fresh air through the work area. It is advisable to use forced ventilation (fan) to improve the flow of fresh air. Because some removers are flammable, however, be sure to read the instructions on the label before using a fan as the friction between metal parts may spark and ignite the vapors. The label is the key. It will advise you on proper ventilation. • Do not allow children to play in the work area to avoid exposure to paint -removing chemicals. Set Up When setting up your work area, it is a good idea to elevate the work by using saw horses or some equally sturdy support. They are not one chemical, but a combination of chemicals, each with a specific job to do. The active ingredient is usually a chemical called methylene chloride. Some products contain active ingredients other than methylene chloride, but they are not as effective in penetrating, blistering, and lifting the old finish. Other chemicals in paint removers work to accelerate the stripping process, to slow the evaporation of the stripper, and to act as thickening agents. Paint strippers typically come in two forms: liquid and semi -paste. In general, the liquid works faster. The semi -paste is best for all-around work, because it doesn't run or drip when applied to vertical surfaces. It goes without saying that any chemical or combination of chemicals with the potency to lift off old paint should be treated with respect. Solvent -based strippers work fast and are harmless to wood, but they may pose health hazards to humans and should be used in accordance with manufacturer's instructions. We have included a list of safety and health tips. But no list can take the place of the manufacturer's recommended use of its product. Knowing the proper use of chemical paint remover, and how to avoid potentially adverse effects from overexposure, will make the experience that much more enjoyable. Moreover, the confidence that comes from such knowledge will no doubt have a positive effect upon the quality of your work. Listed below are some safety tips you should consult before and during your refinishing project. 1. Read the label carefully. Familiarize yourself with the safety precautions printed on the manufacturer's label. Refer to it periodically during the project. 2. Provide maximum fresh air flow through the work area. Avoid inhaling solvent vapors as much as possible. Take frequent fresh air breaks. 3. Wear safety goggles while handling the remover. If any remover gets into the eyes, wash with water. Keep your eyelids open, even if you have to hold them open with your fingers. (Keeping the eyelids open allows air in to evaporate the substance). If burning sensation persists after about ten minutes, see a physician. 4. Cover all skin areas. Wear chemical -resistant rubber gloves made of neoprene or butyl. Also wear long-sleeved shirt, pants, socks, shoes, and a hat or cap (especially if you're working at or above eye level). If any of the remover gets on the skin, wash off with soap and water. 5. Avoid smoking. Don't work in an area where there is a possibility of sparks or flames. 6. Open the container of remover carefully. Cover it with a cloth and open the cap slowly to allow the gases to escape gradually. Pour enough remover for your immediate working needs into a metal can and replace the cap tightly. Repeat this procedure each time you reopen the container. Store the container in a cool place when not in use. 7. Don't store unused paint remover around the house. Buy only what you need. 8. Keep paint remover and other household chemicals out of the reach of children. Any potential health risk from exposure to paint removing chemicals depends on the amount and duration of exposure. Some physical symptoms that indicate overexposure are eye irritation, dizziness, light-headedness, and/or headache. As soon as you experience any of these, take a break and get some fresh air. Do not resume the project until you have increased the ventilation through the work area. Steve appears to be running a very low impact "cottage industry" from his workshop next door. If it weren't for the occasional hum of his sanding equipment, my family would hardly be aware of Steve's activities. There has been no appreciable increase in traffic since Steve started his work, and there seems to be little or no commercial activity on site. Steve brings in the rough pieces of furniture, fixes them up and delivers them to antique shops for resale. At this time, I have no problem with the County granting Steve the conditional use permit.
