Please ensure a copy of the approved permit assembly is kept at the job site whenever
working within the Route 600 right-of-way. I would also like to remind you of the need to
erect and maintain proper traffic control in accordance with our Virginia Work Area
Protection Manual.

Dear Mr. Pitts:
This letter is to confirm action taken by the Frederick County Board of Supervisors at their meeting of October
26, 1998. Your Conditional Use Permit, 9007-98 for a public garage without body repair, was approved with
the following conditions:
l . All repair work shall take place entirely within an enclosed structure.
2. All exterior storage of parts and equipment shall be screened from the view of surrounding
properties by an opaque fence or screen at least five (5) feet in height. This fence or screen shall
be adequately maintained.
Any proposed signs shall satisfy the Cottage Occupation sign requirements.
4. No more than five vehicles awaiting repair shall be located externally to the garage. Vehicles
awaiting repair must be located to the rear of the building.
No inoperative vehicles shall be allowed on the property at any time.
6. All review agency comments shall be complied with at all times.
7. Any expansion of the business shall require a new Conditional Use Permit.
8. The entrance to the garage shall be located adjacent to the northern property line and the
embankment along Route 600 shall be regraded to accommodate the minimum sight distances
required by VDOT.

REVIEW EVALUATIONS:
Virginia Dept. of Transportation: Existing private entrance is inadequate for proposed use.
Minimum sight distances are not obtainable at the property to allow for the construction of
a commercial entrance without the removal of vegetation along Route 600 (Back Mountain
Road). Also, existing entrance must be upgraded to conform with VDOT minimum
standards. Therefore, we cannot support a conditional or special use permit for this property
at this time.
Inspections Department: Building shall comply with the Virginia Uniform Statewide
Building Code and Section 311, Use Group S (Storage) of the BOCA National Building
Code/1996. Other codes that apply are CABO Al17.1-92, Accessible and Useable Buildings
and Facilities. Please submit a floor plan of the existing building for review at the time of
change of use permit application. Handicap parking and access shall be provided to the
structure.
Fire Marshal: No comments. Recommend plan approval.

Health Department: The Health Department has no objections to the issuance of this
conditional use permit as proposed. Sewage flow to the existing on -site sewage disposal
system would not be increased since restrooms will not be provided for public use, and the
operation will be limited to one employee who lives at the existing residence.
Planning and Zoning:
Public garages without auto body repair are permitted in the RA Zoning District with an
approved CUP provided that all repair work takes place entirely within an enclosed structure
and all exterior storage of parts and equipment is fully screened from view from any adjoining
property.
The requested activity will occur within an existing 30' x 56' building; no new buildings are
proposed. The existing building is located adjacent to property owned by a hunt club. This
property is heavily wooded. In addition, locating the parts, equipment and vehicles awaiting
repair to the rear of the garage, and implementing the required screening will further minimize
the impact of any activity on the Pitt's site to the adjoining properties.
Staff believes that the establishment of this business would not have a negative impact upon
the surrounding neighborhood.
STAFF RECOMMENDATION FOR 10-07-98 PLANNING COMMISSION MEETING:
Staff recommends approval with the following conditions:

PLANNING COMMISSION SUMMARY & ACTION OF 10/07/98 MEETING: The staff
reported that the only outstanding review agency comment was from VDOT, which concerned
achieving satisfactory site distance at the entrance. Removal of vegetation along the Back Mountain
Road right-of-way by Mr. Pitts still did not achieve satisfactory sight distance. The staff reported that
an agreement was reached to relocate the entrance directly adjacent to the northern property line, in
conjunction with regrading the embankment to achieve minimum sight distances. VDOT's initial
concerns will be satisfied, however, the entrance will still need to be constructed to VDOT's
minimum commercial standards.
There were no public comments. The Planning Commission raised no points of concern and believed
the conditions associated with the permit would minimize the impact of any activity on the site.
Commissioners unanimously recommended approval of the permit with all conditions recommended
by the staff, plus an additional condition concerning the relocation of the entrance, as follows:

Charles A. Baker et ux, of record in the Clerk's office of the Circuit Court of
Frederick County, Virginia in Deed Book 248 at page 525 and being more

25, 1998 attached hereto.
Reference is hereby made to the aforesaid instruments and the references therein

Date: October 6, 1998
The purpose of this memo is to update the Commission regarding the comments provided by VDOT
for the above referenced Conditional Use Permit application. VDOT has stated that the existing
entrance is inadequate for the proposed use. Minimum sight distances are not obtainable at the
property to allow for the construction of a commercial entrance without the removal of vegetation
along Route 600.
Mr. Pitts proceeded to remove the vegetation along Route 600 to accommodate this comment. Based
upon this improvement, VDOT reinspected the property. VDOT determined that the minimum sight
distances still could not be met. However, VDOT has stated that additional improvements, including
the regrading of the embankment along Route 600 to reduce its height, in conjunction with relocating
the entrance to the northern property line, would achieve the necessary sight distance in both
directions. With a condition to that effect in place, VDOT would recommend approval of the CUP
providing that the relocated entrance conforms to VDOT minimum standards for a commercial
entrance.
Staff would recommend adding the following condition:
* The entrance to the garage shall be located adjacent to the northern property line and the
embankment along Route 600 shall be regraded to accommodate the minimum sight distances
required by VDOT.
