The applicant, Ms. Leda Jane DeHaven, would like to utilize the existing house for a message therapy
business rather than a hair salon. It was determined by staff that since the business was a similar
personal service use to a hair salon and that there would be no increase in intensity nor modifications
to the existing structure, that a revised Conditional Use Permit (CUP) would not be necessary. Please
see attached letter from Ms. DeHaven dated March 11, 2003.
If the applicant wishes to modify the use in any way from a hair salon or message therapy business,
than a reevaluation will be necessary.

of June 11, 1991.
Your conditional use permit #005-91 for a hair salon was approved. This property is located
approximately two miles from Va. Route 37 on Route 789 in the Gainesboro District and is

This conditional use permit was approved with the following conditions:

REVIEW EVALUATIONS:
Virginia Dept. of Transportation: No objections to a
conditional use permit for this property. Existing entrance
appears adequate for proposed use. However, available
property frontage will not allow the installation of an
additional entrance. Should use ever expand in the future or
if accident experience warrants, the entrance may need to be
upgraded to our minimum commercial entrance standards. See
attached letter dated April 10, 1991.
Inspections Dept. The upstairs apartment shall comply with
Use Group "R" Residential, Section 308.0 and the first floor
hair salon shall comply to Use Group "B" Business, Section
303.0 of the BOCA National Building Code 111987".
Health Dept. New drainfield system designed,to accommodate
hair salon. No objection to.proposal - new operation permit
being -issued.

Fire Marshal: Fire separation between apartment unit and
beauty salon will be dictated by the BOCA Building Code and
shall be complied with. During construction, access for fire
dept. apparatus must be maintained at all times. I do not
feel that this type of use will create any unusual or abnormal
hazard for fire and rescue personnel nor will it have an
adverse effect on fire and rescue resources.
Planning & Zoning: This beauty salon will come under the
definition of a cottage occupation and is permitted in the RA
zone with an approved conditional use permit. There should
be adequate parking and a safe entrance once the requirements
of VDOT are complied with. No adverse impact on the
neighborhood would be expected with this use.
STAFF RECOMMENDATIONS FOR 615191 P/C MEETING: Approval with the
following conditions:
1. Requirements of all review agencies will be met prior to
beginning operations.
ADDITIONAL STAFF COMMENTS: June 6, 1991: At their June 5, 1991
meeting, the Planning Commission discussed the fact that someone
needed to live in the house for this application to be classed as
a cottage occupation. Since the applicant intends to have an
apartment in the upstairs portion of this house and the apartment
dweller will be an employee in the salon, the commission indicated
this would qualify. They also directed that the Ordinance
Subcommittee consider amending the Zoning ordinance to permit
Beauty Salons in the Rural Area (RA) Zoning District by right.
Since the applicant must install a commercial entrance and put in
a new septic system, it was felt that there would either be a
resident in the house or the ordinance would be changed to
accommodate this use by the time these things were accomplished.
The Planning Commission made their decision for unanimous approval
based on this information.

This is to follow-up on our meeting of April 3, 1991 wherein we discussed your
proposal to operate a hair salon and apartment unit under a conditional use
permit at the referenced location. As I stated we have no objection to a
conditional use permit being issued by Frederick County to cover the operation
of your business. However, prior to operation of the business a commercial
entrance must be constructed to our minimum standards to allow for safe egress
and ingress of the property. Any work performed on the State's right-of-way
must be covered under a land use permit. Said permit is issued by this office
and will require an inspection fee and surety bond coverage.
Should you have any questions concerning the above or if we can be of further
assistance, please let me know.
