This is to keep you updated on the status of my Veterinarian Hospital at 677 Walters
Mill Lane in Stephenson, Virginia. I have for the time being ceased practicing directly at
the kennel because of various problems with the new owner of Aberdeen Acres Kennel,
Mr. Ebersole. Enclosed is a copy of a letter sent to the Virginia Board of Veterinary
Medicine outlining some of these problems.
My plans are to use the barn located on the same property and owned by Mr. and Mrs.
Anderson for the practice of Veterinary medicine. Therefore, I am retaining my
conditional use permit.

I need to cancel this permit immediately. Furthermore,
please be advised the new owner, Russ Ebersole, of the kennel where
my veterinary practice is, has barred me from the building. Mr.
Ebersole bought the property located at 667 Walter's Mill Lane,
Stephenson, Virginia 22656, known as Aberdeen Acres Kennels,
about two (2) weeks ago. No lease or working relationship could
be reached with Mr. Ebersole, therefore, last week I told Mr.
Ebersole that I would close my practice and remove all of the
equipment, drugs, records, etc. that are my property.
Mr. Ebersole has now stolen various checks, totaling
approximately $2,000.00, made payable to me. He has removed all
of my veterinary records, and will not allow me access to the
building. At this time, I can not get my equipment, drugs, etc.
out of this building. i have contacted the local sheriff, Mr.
Bob Williamson. His phone number is (540) 662-6168. The Sheriff
is being kept up-to-date with this ongoing problem. I have been
able to retreive the controlled drugs. But, there is other
prescription items, veterinary equipment, supplies, records,
etc. that are still there. Again, I am not allowed access to these
items. This is a serious matter and am at a loss as to. what to
do. I am asking for your assistance.

Dear Dr. Casey:
Thank you very much for your recent letter advising me of the status of your CUP for operation
of veterinarian services in association with Aberdeen Kennels. It is very unfortunate that you are
having difficulty with the new owner.
Unfortunately, the CUP that was approved for you was approved to be in, and associated with,
the kennel. I believe that establishing the same service outside the kennel is a violation of the
CUP. During the public hearing process for your CUP, it was clearly pointed out in the staff
report that "this proposed use is to be co -located with the existing dog kennel that is operated by
the Andersons under CUP 4001-86 that was updated in 1990 due to expansion of their facility.
Since this veterinary service is being operated in conjunction with the kennel, it does not appear
that this will create any additional impacts."
Moreover, a CUP runs with the land or location and not with the applicant. For instance, in this
case, Mr. Ebersole could under the CUP that you applied for, have a veterinary clinic associated
and co -located with the kennel. What this means is that you do not have a permit to establish a
clinic or hospital outside the kennel on this property.
I would be happy to work with you to get another CUP for another location on the property if you
desire. Sorry for having to give you more bad news on top of your existing troubles. Should you
have any questions, please do not hesitate to give me a call.

Planning Department: A veterinary office, clinic or hospital is
a permitted use in the RA zoning district with an approved
conditional use permit. This proposed use is to be do -located
with the existing dog kennel that is operated by the Anderson's
under CUP # 001-86 that was updated in 1990 due to expansion of
their facility. Since this veterinary service is being operated
in conjunction with the kennel, it does not appear that this use
will create any additional impacts.
STAFF RECOMMENDATION FOR January 4, 1994: Approval with the
following conditions:
1. Any expansion of facilities to accommodate this use will
require revision of the original kennel site plan.
2. Any expansion of buildings or facilities beyond that
approved by the original site plan will also require a new or
amended conditional use permit.
SUMMARY OF 114195 PLANNING COMMISSION ACTION: Two citizens appeared
at the public hearing to speak in opposition to this request. Both
objected mainly because of the amount of traffic and the condition of
the road. One citizen felt the addition of the vet clinic was just
the beginning of what would probably be other additions to the
operation and that it would probably become a "strip mall." The
other citizen spoke in favor of the clinic but was concerned about
the traffic passing by his house since he lived close to the public
road that must be traversed to get to the clinic. Dr. Casey
addressed the Commission and explained the magnitude of the clinic
which he indicated would only operate two days a week depending on
demand.'
The Commission unanimously recommends approval of this request as
presented.

Dear Sirs,
The health department has no objection to your proposal as long as there is no
increase in water use. According to Mrs. Anderson today, there are presently
two full-time employees, two part- time employees, and Dr. Casey who is present
one or two days per week. Based on 25 gal per day per eight employee hours which
is the average derived from the Sewage Handling and Disposal Regulations, the
design water use is 200 gallons per day based on peak flow. According to the
files, the septic system serving the establishment was designed for 218 gallons
per day.
The subject septic system appeared to be functioning properly today as determined
by a walkover only.

Request for Master Development Plan:
The Developer should be familiar with and be required to
comply with the provisions of the Frederick County Airport Zoning
District (AP-1) and Airport Support Area (ASA) described in the
Frederick County Comprehensive Policy Plan. The developer should
also be familiar with the provisions and requirements of the
following codes:
Title 15.1 Code of Virginia, Section 489 (Purpose of Zoning
Ordinances) and Section 491.02 (Airport Safety Zoning).
Title 5.1-25.1 Code of Virginia (Permits Required for Erection of
Certain structures.)
As Winchester Regional Airport expands services and
operations, noise associated with such expansion is very likely
to increase. The Airport Support Area established by the
Frederick County Comprehensive Policy Plan is designed to
discourage residential development in the vicinity of the airport
to preclude citizen concerns for noise created by aircraft
operating on, to and from Winchester Regional Airport.
If the developer is planning residential development
adjacent to the ASA or under a flight path used regularly by
aircraft outside of the ASA as they arrive or depart the Airport,
he should be either required or encouraged to insulate all
habitable structures for noise and be required to specifically
address, in the property Covenants and Easements, existing
airport related noise and the probability of increased noise as
airport operations expand.
