This letter is to confirm action taken by the Frederick County Board of Supervisors at their
meeting of August 11, 1993.
Conditional use permit, #002-93, was approved for an off premise business sign. This property
is located on the west side of Aylor Road (Route 647) at the intersection of Westmoreland
Drive, in the Opequon District, and is identified as PIN 75-A-37.
This use has been approved provided the following conditions, placed upon the permit by the
Board of Supervisors, are complied with:
1. The sign must meet all requirements of the Frederick County Zoning Ordinance and
the Code of Virginia.
2. Sign must be removed and/or relocated when construction of house is completed on
the adjoining property.

REVIEW EVALUATIONS:
Virginia Department of Transportation: In accordance with the
laws of the Commonwealth of Virginia, no private advertisement
sign can be placed on the State's right-of-way. Prior to
erection on private property, a permit may have to be applied
for through our District Office in Staunton.
Inspections Department: Sign shall comply with the Virginia
Uniform Statewide Building Code and Section 311, Use Group U
(utility and misc.) of the BOCA National Building Code/1990.
Planning Department: (March 3, 1993) Since this sign is so
far removed from the subdivision that it advertises, it is
considered a business sign and not a simple real estate sign.
Off premise business signs require a conditional use permit.
The sign is currently existing and this application is a
result of a complaint against the applicant.

Planning Department: (July 7, 1993) This application was
previously approved by the Commission. Prior to the public
hearing at the Board of Supervisors meeting it was discovered
that one adjoining property owner had not been notified and
the applicant was required to resubmit a corrected
application. There is an intervening parcel between the
parcel where the sign is located and the adjoiner that was not
notified, however, the parcel is owned by the same party.
STAFF RECOMMENDATIONS FOR JULY 7, 1993 PC MEETING: Approval with
the following condition:
1. That the sign meet all the requirements of the Frederick
County Zoning Ordinance and the Code of Virginia.
PLANNING COMMISSION ACTION SUMMARY: No one spoke in opposition to
this application and it was unanimously recommended for approval by
the Board.
PLANNING COMMISSION RECOMMENDATIONS OF JULY 7, 1993: Unanimous
approval .with the following condition: (absent,- M. Copenhaver and
T. Shenk)

Since Ryland Homes has elected to ignore the requirement to proceed with the conditional use
permit application for your sign, located along Route 647 on the Abundant Life Christian Center
property, I now must take appropriate action to correct this violation.
You are now directed to remove the off premise sign in question within five days from the
receipt of this letter. Failure to remove the sign will result in a criminal violation being filed
against your business for violation of Section 165-30-D of the Frederick County Zoning
Ordinance. This violation may result in a $1,000.00 a day fine for each day the violation exists.
