Dear Mr. Boyer:
This letter is to confirm action taken by the Frederick County Board of Supervisors at their
meeting of September 9, 1992.
Your conditional use permit, #010-92, was approved for a. landscaping business. This
property is located on Route 277 East, in the Shawnee District and is identified as GPIN
860000A0001590.
The following conditions have been placed -upon your permit:
1. Any change in use shall require a new conditional use permit.
2. No more than one sign will be allowed and it shall be limited to eight square
feet.
3. No structures shall be expanded to contain the use unless a revised
Conditional Use Permit is obtained.
4. All review agency comments must be addressed, including the submittal of an
engineered site plan. A site plan is to be submitted within 30 days of
meeting.
5. Adequate parking shall be provided for employees, customers and delivery
vehicles (per Article III, section 3-3 of the Zoning Ordinance).
6. Business must move from current location on Route 647 to approved location
within 60 days of Board of Supervisors approval.

REVIEW EVALUATIONS:
Virginia Department of Transportation: No objection to
conditional use permit for this property. However, existing
private entrance is inadequate for proposed use. Prior to
operation of the business, a commercial entrance must be
constructed to our minimum standards to allow for safe
egress/ingress on the property. Any work performed on the
state's right-of-way must be covered under a Land Use Permit.
The permit is issued by this office and requires an Inspection
Fee and Surety Bond Coverage.
Fire Marshal: Access to all buildings shall comply with BOCA
Building Code and Frederick County Fire Protection Ordinance.
Applicant must comply with Sara Title III requirements for
storage of pesticides. Any areas open to the public shall be
maintained in compliance with the VA State Fire Prevention
Code at all times. Burning of debris on -site without proper
permits is prohibited.

Inspections Department: Building shall comply with the
Virginia Uniform Statewide Building Code and Section 303, USE
Group B, (Business) of the BOCA National Building Code/1990.
Other codes that apply are title 28 Code of Federal
Regulations, Part 36 Nondiscrimination of the basis of
Disability by Public Accommodation and in Commercial
Facilities. Permit required shall be a change of use on
existing building.
Health Dept.: Health Dept. has no objection to landscape
business provided no more that two employees on -site during
working hours and no more that three other employees working
mostly off -site. No approval of house for full-time residents
is indicated here.
Sanitation Authority: No comments.
Planning Department: This Conditional Use Permit application
is for an existing landscape business that was unknowingly
operating illegally in the Residential Performance district.
The piece of Rural Area ground that the applicant is proposing
to move to is suitable for a landscaping business. An
existing house will serve as the office. Equipment and
nursery items will be kept at the rear of the property which
is buffered somewhat by distance and existing vegetation.
Approval of this permit will not significantly alter the
established pattern of land use in this area, since Swift
Transportation is nearby, as well as a lawn mower sales and
repair business. However, the staff is uncomfortable with the
prospect of having this Conditional Use Permit approved
without a site plan on file to mirror what is actually being
developed on site.
STAFF RECOMMENDATIONS FOR AUGUST 5, 1992: Approval with the
following conditions:
