PROPOSED USE: Fish Hatchery and Public Fishing Pond REVIEW EVALUATION: Virginia Dept. of Transportation: No objection to conditional use permit for this property. The existing entrance appears adequate for the proposed use. However, should use ever expand in the future or if traffic conditions/accident 'experience warrant, the entrance may have to be upgraded to VDOT minimum commercial entrance standards. Inspections Dept. Since this trout farm does not have any plans for a structure coinciding with its use group, the BOCA National Code 1987 does not apply at this time. Health Dept. No objection - pit or vault privy can be added later if necessary. Fire Marshal: Approval of this conditional use permit would not significantly affect fire and rescue resources. The only hazard I can see would be unsupervised children around the fishing pond, which probably won't be allowed by the owners anyway since this is paid fishing. Planning & Zoning: The Frederick County Zoning Ordinance permits fish hatcheries and fish production with a conditional use permit. Applicant plans to raise trout from the fingerling stage and stock a pond that will be used for public fishing for pay. Ponds will be scooped out from ground level and no dams will be built. Caution will need to be used during construction to protect the adjoining natural stream from sedimentation contamination.
