This letter is to confirm action taken by the Frederick County Board of Supervisors at their
meeting of October 23, 1991.
Your conditional use permit, #011-91, was approved for a public garage with truck repair
service. This property is located off of Route 631, one half mile down Route 629, in the Back
Creek District and is identified. as GPIN 740000A000010F.
This conditional usepermit was approved with the following conditions:
1. This permit will be reviewed and renewed annually..
2. All repair work shall take place entirely within an enclosed structure.
3. All exterior storage of ' parts and equipment shall be screened from view of
surrounding properties.
4. No inoperative vehicles will be stored on the property.
5. The number of vehicles awaiting repair shall be limited to a maximum of five (5)

REVIEW EVALUATIONS:
Virginia Dept. of Transportation: No objection to conditional
use permit for this property. Existing entrance is adequate
for proposed use. However, should use ever expand in the
future, the entrance may have to be upgraded to VDOT minimum
commercial standards.
Fire Marshal: Auto repair shops typically have hazards
associated with flammable and combustible liquids and storage
of same. 1) Request that all code requirements as stated in
BOCA Building Code as well as the Fire Prevention Code be a
condition of approval. 2) Recommend annual fire inspection
by Fire Marshal's office as a condition of the permit. 3) No
outdoor burning of refuse is permitted at any time. 4) As a
condition of approval, this facility should remain in
compliance with the State Fire Prevention Code at all times.
Inspections Department: Building shall comply with the
Virginia Uniform Statewide Building Code and Section 310 Use

Health Department: No objection as there is no running water
or bathroom in building.
Planning & Zoning: The zoning ordinance permits a public
garage with a CUP. The building in which the applicant will
be doing the truck repair work is located behind his residence
and is screened on two sides by mature orchards and one side
by woodland. The facility would not be visible from any other
residence. Allowing this activity should not change the
character of the area of proposed use.
STAPP RECOMMENDATIONS FOR 10/02/91 PC MTG.: Approval with the
following conditions:
1. This permit will be reviewed and renewed annually.
2. All repair work shall take place entirely within an
enclosed structure.
3. All exterior storage of parts and equipment shall be
screened from view of surrounding properties.
4. No inoperative vehicles will be stored on the property.
5. The number of vehicles awaiting repair shall be limited to
a maximum of three.
6. Increase in intensity of the use or expansion of the
building will require a new conditional use permit.
7. The BOCA Building Code and the Fire Prevention Code will be
complied with at all times.
