This letter is to .confirm action taken by the Frederick County
Board of Supervisors at their meeting of January 9, 1991. A
Conditional Use Permit #018-90 was approved for a public garage.
This property is located off of old Route 522 North, opposite the
intersection with Route 701,_at Cross Junction in the Gainesboro
Magisterial.District and is identified by property ID# 18000-A00-
0000-0000-00260.
This conditional use permit was approved with the following
conditions:
1. This is a one year permit to be reviewed and renewed
annually to ensure compliance with conditions.
2. Health Department approval of the septic system must be
obtained.
3. Vehicles awaiting repair must be screened from view from
the road and surrounding properties.
4. Parking space for five vehicles will be provided.
5. Hours of operation will be limited from 7:00 a.m. to 8:
p.m., Monday through Saturday.
6. Any expansion or change of use of this facility shall

REVIEW EVALUATIONS:
Fire Marshal: Paint spray booth is required to be built in
compliance with the Statewide Building Code. It is also
required to be sprinkl'ered in accordance with B.O.C.A. Article
10. See attached additional comments.
Inspections Department: This request for CUP approval shall
comply to Use Group "S" Storage, Section 310.0, and if spray
painting will be used, Use Group "H" High Hazard, Section
306.0, of the BOCA National Building Code 111987".
VA Department of Transportation: No objection to conditional
use permit for this property. Existing entrance is adequate
for proposed use. However, should use ever expand or traffic
conditions warrant, the entrance may have to be upgraded to
our minimum commercial entrance standards in the future.
Health Department: Drainfield must be expanded. The Health
Dept. cannot approve this request at this time.
Planning and Zoning: This use will not change the character
and established pattern of development in the area. The
existing building was used for TV sales and service from the
1960's to 1976, then for a construction office until 1985,
then as a public garage with body repair until present.
This office has no objection to a conditional use permit for
the property, provided the'drainfield concerns raised by the
Health Department are.taken care of.
STAFF RECOMMENDATIONS FOR 1215190 P/C MEETING: Approval with the
following conditions:
1) This is a one year permit, to be reviewed and renewed
annually to ensure compliance with these conditions.
2) Health Department approval of the septic system be
obtained.
3) Vehicles awaiting repair be limited to five and screened
from view from the road and surrounding properties.
4) Parking space for five vehicles be provided.
5) Hours of operation be limited from 7:00 am to 8:00 pm
Monday through Saturday.
6) Any expansion or change of use of this facility shall
require,a new conditional Use Permit.

Additional Comments: There are certain inherent hazards with this type of
use due to flammable and combustible liquids being present. Also, spray-
ing operations of flammable finishes is a very high hazard. Both the
Building Code and Fire Prevention Code address these problem areas quite
thoroughly. I recommend that approval of this permit be contingent on
compliance with all applicable codes and an annual inspection by the
Fire Marshal's Office.
