Dear Mr. Rogers:
This letter is to confirm action taken by the Frederick County
Board of Supervisors at their meeting of September 12, 1990.
Conditional Use Permit #011-90 of Allen E. Rogers was approved for
a lawn care service company office and warehouse and equipment
storage. This property is located just north of Opequon, on the
east side of Route 620, just north of its intersection with Route
622 and is identified as parcel nos 92 and 93 on tax map 61 in the
Back Creek Magisterial District.
This CUP was approved with the following conditions:
1. This is a one year permit to be reviewed and renewed
annually by the staff, the Planning Commission and the
Board of Supervisors.
2. If the use, occupancy of ownership of the property
changes, this permit shall expire.
3. This permit is subject to continued compliance with
Virginia Department of Transportation (VDOT) entrance
requirements. This entrance off of State Route 620 will
not be used by customers until VDOT requirements are
established and adequate off-street parking will be
provided for employees.
4. The applicant will provide the Fire Marshal with an up-
dated description of the type, and characteristic of
pesticides and fertilizers being stored within one month
of receiving an occupancy permit subject to annual
inspection by Fire Marshal and an annual report must be
presented to the Frederick County Planning Department.

REVIEW EVALUATIONS:
Va. Dept. of Transportation: Existing entrance will be
acceptable for the proposed use, provided that all traffic
associated with the business will be restricted to employees
of the business, expected to be 6 to 8 persons, meaning that
absolutely no customers will be allowed to use the entrance.
Further, VDOT reserves the right to re-evaluate this entrance
and require that it be upgraded to minimum commercial
standards if the degree of its use increases.
Fire Marshal: Need to be advised of type, quantity, and
characteristics of pesticides and fertilizers being stored

when building is occupied. Existing barns OK for equipment
storage. Fire aspects will be addressed by Building Code.
Health Department: A suitable drain field site has been found
to accommodate the office and warehouse.
Inspections Department: Shall comply to Use Group "S"
(storage) Section 310.0 of the BOCA National Building Code,
1987. Existing barns must also meet Use -Group "S" standards.
Planning and Zoning: A Conditional Use Permit is required for
a landscape contracting business in the RA (Rural Areas)
zoning district. This use does not appear likely to change
the character and established pattern of development in the
area. It does not appear that the proposed building would be
very noticeable from the road or existing dwellings. However,
an adjoining lot is being considered for residential
development.
STAFF RECOMMENDATIONS FOR 811190 P/C MEETING: Approval with the
following conditions:
1. This is a one-year permit, to be reviewed and renewed annually
by the staff, the Planning Commission, and the Board of
Supervisors.
2. If the use, occupancy, or ownership of the property changes,
this permit shall expire.
3. This permit is subject to continued compliance with Virginia
