RE: Request of Robert Pesto to Provide Food Service at Apple Land Recreational
Center.
Dear Mr. Gregory:
Our department received a telephone call from Mr. Robert Pesto on Thursday, January 14,
1993. Mr. Pesto was interested in providing a mobile food service stand at Apple Land
Recreational Center as a seasonal operation. I told Mr. Pesto that the uses associated with
this site were permitted with a Conditional Use Permit; therefore, I would have to research
this further.
As you know, Conditional Use Permit #006-90 of Gregory Investments was approved by the
Board of Supervisors on July 11, 1990. Condition number five (5) states that the applicant
shall comply with all items listed in the "Specifications Foresight" listing. This listing
declares that the Red Barn and silo will be remodeled in the future for use as a snack bar,
among other things. With this in mind, it is difficult for our department to respond to Mr.
Pesto's questions. Questions regarding the intensity, location, and proposed timetable
associated with this use need to be discussed prior to a final decision being made by this
office.

Dear Mr. Gregory:
I have been presented with a copy of an analysis of existing water use and customer data
for your facility that was completed by E.R. Sutherland, P.E. of G.W. Clifford &
Associates. The study considers your present water use, the existing activities at your
facility and proposed expansion plans. Mr. Sutherland concludes that wastewater
facilities capable of disposing of at least an additional 600 gallons per day will be
required to support the proposed Appleland Sports Center facility expansion. The
expansion as he states will include 32 driving range tees and a Go kart track, as well as an
addition of 2 full time and 2 part time personnel. The health department files indicate
that you were issued a sewage disposal system construction permit on 7/9/90 for 680
gallons per day and another permit on 2/19/99 for 730 gallons per day (the 2/19/99
system has not yet been installed). With this in mind, according to Mr. Sutherland's
study, you have been issued permits from the Health Department that exceed that
proposed water use that includes the expansions as listed above. I have contacted the
Frederick County Inspections Department regarding this information and have given
Health Department approval for the driving range expansion based on your engineered
study.
This approval does not take into account equalization of the wastewater flow between the
2 separate disposal systems. This is a critical issue and will be very difficult to obtain
and constantly monitor. As you have many different attractions at your facility, it is very
important that restroom facilities be placed in a manner with the hope that approximately
50% of your customer base will use restrooms that are served by different disposal
systems. I do want to make you aware that if a particular disposal system becomes
overloaded, a malfunction will likely occur.

You have also requested permission to place a seasonal food stand and/or ice cream
convenience stand at your facility. By calculating your permitted usage in comparison to
the results of the engineered study, it appears that you have an additional 138 gallons per
day of wastewater capacity. It has been my experience that a "seasonal mobile food
stand", (including employees) would produce approximately this volume per day.
Therefore, if the operator of this unit is successful in obtaining a Health Department
restaurant permit, there appears to be a means for sewage disposal for the unit. Please
note, we are only granting approval for 1 unit, not a separate unit for ice cream as well as
a unit for food. The unit must be temporary mobile unit, not a permanent restaurant
facility. The unit must have a "hard pipe" connection for both approved water and
sewage disposal. You must also have a means of protecting the sewage disposal system
from grease, such as a concrete grease trap. The sewage piping from this unit must be
connected to the drainfield that will receive the lowest projected restroom flow.
In summary, with this letter you are given Health Department approval for the following
based on the engineered water usage study:
Existing Driving Range Proposed Go-kart track
Existing Mini -golf Proposed addition of 32 driving range tees
Existing Batting Cage Proposed addition of 1 temporary food unit
Employees for these existing operations Employees for these proposed operations
Any future expansions or additions at your facility other than those listed in this letter
will require Health Department approval (i.e. additional means of sewage disposal).
In closing, all of the approvals mentioned on page 1 and 2 are based off of an engineered
study that was completed by E.R. Sutherland, P.E. 'This letter does not imply that the
sewage disposal systems will continue to properly function for any given amount of time.
If a system malfunction occurs, immediate repair will be necessary. If you have any
questions, concerning this approval, please call at any time.

I have been contacted by the Frederick County Department of Planning and Zoning
regarding the proposed changes to the driving range at your sports center. I have just
completed a review of the file pertaining to your property and I am listing comments
below that may have an impact on your future plans as well as your current operations at
Appleland Sports.
As of this date, the Frederick County Health Department has issued 2 sewage disposal
system construction permits for your property. The first permit (SD-90-187) was issued
on 7-9-90. This system was installed in 1990 and an Operation Permit was issued for
water usage of 120 customers per day and 4 employees. The permit specifically states
that the drainfield is designed to serve customers for the driving range ONLY. The
second permit (99028458) was issued on 2-19-99. This system has not been installed as
of this date. The system was designed and permitted for 100 customers per day and 4
employees at a proposed Go -Cart Track. The system will also accommodate rinse water
from a portable ice-cream convenience stand.
Any other future activites at your property DO NOT have approval of the Frederick
County Health Department. It would be necessary for you to submit an application to
this office for a 11-�. drainfie:d or system exparision and an evaluation would be
completed in order to determine if approval can be granted. If you have any questions,
please call at any time.

In reference to your letter of April 9, 1999.
In the summary portion of the letter, you give approval for the following:
Existing Driving Range, Mini Golf, Batting -Cages, Employees for existing
operation, Proposed Go CartTrack; a0ditiona1.32 Tees .to Driving Range,
1 Temporary Food Unit, Employees for proposed operation.
In 1989 I was granted a C.U.P. by Frederick County.after complying with all agency requests,
including Environmental Health. You have been given a copy of the C.U.P. It states the
following uses, Golf, Driving Range, Miniature Golf, Batting Cages, Arcade, Snack Bar. After
the permit was granted, there was a misunderstanding about the retail sales of sports related
products. This was cleared up by a letter signed by the C.O.B. of Supervisors, Kenneth Stiles
and others.
The Health Department granted a permit for this C.U.P. as it's requirements to allow construction
of the facility. Now ten years later, I find the permit was written incorrectly. I didn't know that
the permit had to list each specific use. I thought it was to satisfy the C.U.P. # 006-90 issued by
Frederick County
1 do not believe Frederick County would have stated all the permitted uses, if they knew a Health
Permit was being issued for only some of them.
Since it appears that each use apparently must be spelled out on the Health Department Permit,
rather that a simple reference to the C.U.P. permit number issued by Frederick County, a
clarification of your letter is in order. It does not list the uses stated in the original permit. It,
also, does not list the uses of the recent C.U.P.
The process to be granted a C.U.P. by Frederick County is a very lengthy one and for one do not
wish to go through again.

In February 1998, we met with your agency and others for comments. We
discussed all our plans, your agency's requirements was for an additional septic
system. We applied for a permit and located a suitable site. I would have stopped
there, had a site not been found, the first step.
I then applied for the C.U.P. stating our plans, A written comment was required
from your agency, Environmental Health, the second step.
After all agency's comments, we proceeded up the ladder to obtain a C.U.P. Each
step is costly and would not be taken only to have it taken away after meeting or
exceeding the requirements set forth by the various agencies.
Your letter omits present uses allowed, that being related retail sales, arcade,
snack bar. All at the original site and all part of the permit # 006-90..
It further omits the Par 3 Golf area and Water Slide Park area, which are part of
the recently approved C.U.P.
A permit to construct elevated tees has been held up for over a month with no
factual basis,' and no opportunity offered to proceed, while we resolve the issue.
At your request, I offered to find more drain field area as a further cushion of use
capacity. I applied fro additional drain field area, paying a $115.00 fee for the
application.
You make no mention of this outstanding permit application in your letter,
If we are going to be very specific on the pennit, we must clear these issues up or
we can reference Environmental Health's permit to the Frederick County C.U.P.,
which I feel is how it should be written.

Prior to receiving a Certificate of Occupancy for the batting cages at the Appleland facility, all site
work must be completed. If the site work has not been completed, but a CO is requested for the
batting cages, a Letter of Credit may be submitted.
♦ Attached is the Letter of Credit form that Frederick County utilizes.
♦ The approved site plan for the batting cages requires that the parking facility be completed
prior to the issuance of a CO. The complete parking facility involves: the parking surface
treatment, lane delineation, and wheel stops.
♦ It is estimated that the parking facility improvements will cost $9,000. Therefore, a Letter
of Credit for $9,000 will be required if the site work is incomplete.
♦ Such a Letter of Credit shall be accompanied by a letter stating that all site work will be
completed within two months (by June 15, 1997). After this date, if Frederick County
deems the site work incomplete, the county may draw on the Letter of Credit to complete
all site work.
♦ When the Department of Planning and Development receive the Letter of Credit and the
accompanying statement concerning the intent to complete all site work by June 15, 1997,
the department will issue their approval for a CO.

Dear Mr. Gyurisin:
I have reviewed all documents relating to the existing Appleland Sports Center that are
contained within our files. A construction permit was issued by this office on July 9,
1990. The system was inspected during partial finals in the months of July, August and
September of 1990. A permit to operate this system was issued by this office on
September 4, 1990. Please note that our permit was issued for a maximum of 120
customers per day and 4 employees.
Sewage disposal system construction permits that are issued under the Virginia Sewage
Handling and Disposal Regulations are based on the maximum daily sewage flow of the
facility or dwelling. Regardless of whether all 120 of the customers goes to the
restroom, the possibility still exists that it could happen. Also, I wanted to bring to your
attention that it is noted on our 1990 permit (SD-90-187) that our approval was for a
driving range only. Based on the above information, it is likely that the existing sewage
disposal system is operating at peak capacity, especially on Saturdays and Sundays.
In closing, our 1990 comments are not applicable for future expansions of Appleland
Sports Center. I'm sure that you will agree that future expansions of the facility will
easily create more than 120 customers per day for the entire complex. With this in mind;
it seems that the best approach would be to plan for additional means of sewa e-disppoQsal
as the project enlarges. This office would support future expansions of the clea�i�f�O V&
adequate sewage disposal can be made available for the expansions.

This letter is to confirm action taken by the Frederick County
Board of Supervisors at their meeting of July 11, 1990.
Conditional Use Permit #006-90 was approved for a recreational area
including golf, driving range, batting cages, mini golf, arcade and
snack bar. This property is located on the west. side of U. S.
Route 11 approximately 1 1/4 miles south of Route 37 across from
the Glass Barn Outlet Store and is identified as parcel 76A on tax
map 74 and parcel 27 on tax map 75 in the Back Creek Magisterial
District.
This conditional use permit is approved with the following
conditions:
1. This permit is to be reviewed and renewed annually by the
staff, the Planning Commission and the Board of Supervisors.
Additional conditions may be attached if additional impacts
occur.
2. If the use, occupancy or ownership of the property
changes, this permit shall expire.
3. A formal site plan must be submitted to address parking,
lighting, buffering and all other normal site plan
requirements.
4. All RA (Rural Areas) Zoning District setback requirements
must be maintained.
5. The applicant shall comply with all items listed in the
"specifications foresight" listing attached to the
application.
6. Lighting must be directed away from U.S. Route 11 and the
adjoining residential areas.

City of Winchester - No comments.
FC Sanitation Authority - Water service would come from the
city of Winchester or by extending FCSA water lines from
Battlefield development. Sewer would come from Battlefield
development also. This parcel is about 1/2 mile from
Battlefield development. See attachment.
Inspections Dept. - Building shall comply with the Virginia
Uniform Statewide Building Code and shall comment on Building
Use Group at the time of structural plans review.
Va. Dept. of Transportation - No objection to a conditional
use permit for this property. However, prior to operation of
the business a commercial entrance must be constructed to our
minimum standards to allow for safe egress and ingress of the
property. Any work performed on the State's right-of-way must
be covered under a land use permit. The permit is issued by
this office and requires an inspection fee and surety bond
coverage.

Health Dept. - Health dept. has no objection to this proposal
as long as existing system is proven to be functioning
properly by uncovering it or permit to install new system is
issued. In either case, the system proposed for use must have
the correct capacity for the proposed water use. Please note
that none of these requirements have been met at this time and
that Mr. Gregory was notified of such on May 1, 1990 by phone.
This proposal is not acceptable to the Health Dept. at this
time.
Planning & Zoning - Commercial outdoor recreation is a
permitted use in the Rural Area Zoning District with a
conditional use permit. The applicant has been asked to
submit a preliminary site plan with the CUP application in
order to allow full consideration by the Planning Commission
and Board of Supervisors. The applicant is requesting
approval of a parking lot that will be compacted and tapped
with 21A stone in lieu of the paved or concrete area. The
applicant has elected to install a new septic system to meet
the requirements. A new drainfield site had been approved (as
of 5-24-90) and permits were being prepared. Public water
supply exists on the property.
STAFF RECOMMENDATIONS FOR 616190 P/C MEETING: Approved with the
following conditions:
1. This is a one-year permit to be reviewed and renewed annually
by the staff, the Planning Commission and the Board of
Supervisors.
2. If the use, occupancy or ownership of the property changes,
this permit shall expire.
3. A formal site plan must be submitted to address parking,
lighting, buffering and all other normal site plan
requirements.
4. All Rural Area Zoning District (RA) setback requirements must
be maintained.
5. The applicant shall comply with all items listed in the
"specifications foresight" listing attached to the
application.
6. Lighting must be directed away from U.S. Route 11 and the
adjoining residential areas.
