Dear Ms. Zucchi:
This letter is to confirm action taken by the Frederick County
Board of Supervisors at their meeting of March 28, 1990:
Approval of Conditional Use Permit #003-90 of Mariette Lee Zucchi
for a day care center. This property is located at the Calvary
Church of the Brethren on Front Royal Road 0.9 miles off of Route
522 South in the Shawnee Magisterial District and is identified as
parcel 72 on tax map 64.
This Conditional Use Permit is issued with the following
conditions:
1. This is a one year permit to be reviewed and renewed annually.
2. If the use, occupancy, or ownership of the property or
business changes, this Conditional Use Permit shall expire and:
a new Conditional Use Permit will be required..
3. The applicant must comply with all local and state'
requirements necessary for the day care facility operation.
4. The applicant must .comply with the Virginia Department of
Transportation's commercial,entrance requirements.
5. The applicant must provide a statement from the owners of the
property verifying that the applicant has permission to use
the property for a day care center.

PROPOSED USE AND IMPROVEMENTS: Day care center
REVIEW EVALUATIONS:
Va. Dept. of Transportation: No objections to a conditional
use permit for this property. However, prior to operation of
the business a commercial entrance must be constructed to our
minimum standards to allow for safe egress and ingress of the
property. Any work performed on the State's right-of-way must
be covered under a land use permit. This permit is issued by
this office and requires an inspection fee and surety bond
coverage.
Inspections Dept.: This request for CUP approval, shall
comply with use Group "E" Educational Section 304.0 of the
BOCA National Building Code 111987". (Would need permits and
plans before starting work.)
Fire Marshal: 1. No problem with this development. 2.
Depending upon use group classification, Day Care requires
many different items be addressed before occupancy. Please
review basic requirements in detail to avoid delays later.
Health Dept.: No objection as long as facility is connected
to central water and sewer facilities, provided the present
septic tank system is inadequate or not functioning in a
satisfactory manner. Occupant to uncover tank and box.
Planning & Development: The applicant is requesting a CUP
for a day care facility to be conducted in an accessory
building of a church. This facility is located in the RP Page

district and is a permitted use with a CUP. The use must
comply with all fire and health requirements.
STAFF RECOMMENDATIONS FOR 317190:
1. This is a one year permit to be reviewed and renewed
annually.
2. If the use, occupancy, or ownership of the property or
business changes, this CUP shall expire and a new CUP will be
required.
3. Applicant must comply with all local and state
requirements necessary for day care facility operation.
4. Applicant must comply with the Virginia Department of
Transportation commercial entrance requirements.
PLANNING COMMISSION RECOMMENDATIONS OF 317190: Unanimous approval
with the following conditions:
