Dear Mr. Holliday:
This letter is to confirm action taken by the Frederick County
Board of Supervisors at their meeting of December 13, 1989.
Approval of Conditional Use Permit #018-89 for a day care facility
to be located at the Southeast corner and the intersection of State
Route 642 and Chinkapin Drive (Lakeside Estates), in the Shawnee
Magisterial District. This conditional use permit was approved
with the following conditions:
1. The site plan approval process must be completed with all...;.;
review evaluation comments that require action being properly
addressed. „
2. Approval to be for unlimited time unless the use or occupancy
- of the property changes. Should this occur, this conditional
use permit shall expire and a new conditional use permit will
be required.

REVIEW EVALUATIONS:
VA Dept. of Highways & Transportation - No overall objections. Before making
final comments, my office will require a complete set of construction plans,"
drainage calculations, and traffic flow data from the ITE Manual, 4th
Edition, for review. Any work performed on the State's right-of-way will be
covered under a land use permit.
Health Department = No objection; area served by central water and sewer.
Sanitation Authority - Water and sewer capacity is available.
Fire Marshal - 1) Hydrant needs to be placed just off Chinkapin Drive to meet
300' distance for rear of townhouses and day care center. 2) Check the size
of the four -inch water main.
Inspections Department - This request shall comply to Use Group "R."
(Residential), Section 309.0 of the BOCA National Building Code, 1987 for day,
care facility use. The use group will be determined at the time of plans
review.
Planning and Zoning - Day care facility is an authorized use in the RP. Zoning
District, with an approved conditional use permit.
