This letter is to confirm action -taken by the Frederick County
Board of Supervisors at their meeting of October 25, 1989.
Approval of Conditional Use Permit #013-89 of Richard Dale Kerns
and Merle D. Kerns for a country general store, a deli and gas
pumps. This property is located at the intersection of routes 600
and 690, in the southwest corner of Frederick County (Siler Route),
the old Whitacre store, in the Gainesboro Magisterial District.
This conditional use permit is approved with the following
conditions:
1. If the use, occupancy or ownership of the property changes,

LOCATION: At intersection of Route 600 and 690, in the southwest corner of
Frederick County (Siler Route), the old Whitacre store
MAGISTERIAL DISTRICT: Gainesboro
ADJACENT LAND USE AND ZONING: Agricultural land use and RA (Rural Areas) zoning
PROPOSED USE AND IMPROVEMENTS: Open old country general store, selling groceries,
miscellaneous items, possibly having a deli and gas pumps. Future addition or
enlargement.
REVIEW EVALUATIONS:
VA Dept. of Transportation - No objection to conditional use permit for this
property. Prior to operation, a commercial entrance will have to be
constructed to our minimum standards to allow for safe egress and ingress of
the property. There doesn't appear to be enough room in front of the
structures to allow for the entrance, therefore it will have to be moved to
the side. Any work'performed on the State's right-of-way will be covered
under a Land Use Permit.
Sanitation Authority - Water and sewer is not available to this area.
Health Department - The Health Department has no objection to this proposal
as long as the Kerns' proposed system for this store (Permit # SD-89-252) is
installed and approved and water use does not exceed 140 gallons per day.
Fire Marshal - Fire protection plans on site plan must meet Frederick County
Chapter 10.
Inspections - This request shall comply to Use Group "M" Mercantile Section
308.0 of the BOCA National Building Code 1987.
Planning - A conditional use permit was approved for this site in 1979 prior
to the applicant acquiring the property. This permit was not active so a new
application was required. A site plan will be required for the development
of this facility since it is a public use facility.

1. This is a one-year permit to be reviewed and renewed annually by the staff,

use permit shall expire and a new conditional use permit will be required.
3. Off road parking is required.
