This decision was based mainly on the report from Supervisor Rhodes who stated that he had visited the property on July 11, 1990 and found Mr. Goodwin to be in compliance with his permit. W. Goodwin Public Garage with Body Repair LOCATION: On Route 50 at Hayfield MAGISTERIAL DISTRICT: Back Creek ADJACENT LAND USE AND ZONING: Residential; agricultural, and commercial land uses zoned RA (Rural Areas) PROPOSED USE AND IMPROVEMENTS: A steel building 70' x 100'4" x 14' REVIEW EVALUATIONS: VA Dept. of Transportation - No objection to conditional use permit for this property. A commercial entrance will have to be constructed to our minimum standards to allow for safe egress and ingress. All work on the right-of- way will be covered under a land use permit. This permit is issued by my office and will require an inspection fee and surety bond coverage. Health Department - No objection. Approved drainfield at present site. No plans to issue drainfield permit at new site. However, a vault privy or sestriolet can be issued for the new building with flush toilet available in existing building. Frederick County Fire Marshal - I do not believe granting this CUP will add any additional fire load nor create a more severe fire problem. The proposed building would have to comply with the requirements of the Statewide Building Code. Planning and Zoning - Public garages are permitted in the RA District with a CUP, with the following conditions listed below. STAFF RECOMMENDATIONS: Approval, with the following conditions: 1. This is a one-year permit to be reviewed and renewed annually by the staff, the Planning Commission, and the Board of Supervisors. 2. If the use, occupancy, or ownership of the property changes, this conditional use permit shall expire and a new conditional use permit will be required. 3. All repair work shall take place entirely within an enclosed structure 4. All exterior storage of parts and equipment shall be screened from view of surrounding properties by an opaque fence or screen at least five (5) feet in height. Goodwin DATE: April 12, 1990 On July 5, 1989 conditional use permit #011-89 was submitted to you for consideration (see attachment 1). This was a request of Richard L. and Margaret Goodwin to operate a public garage with body repair on their property along Route 50W near Hayfield in the Back Creek District. Planning Commission recommendations of 7/5/89 was unanimous approval with conditions listed on attachment 1. The Board of Supervisors acted on this permit on July 12, 1989. The Board approved the request but placed an additional condition on the permit that no abandoned or junk vehicles be stored on the premises, only vehicles awaiting repair (see attachment 2). The applicant was so informed in the approval letter of July 21, 1989 (attachment 3). Acting on a complaint, I visited Mr. Goodwin's property on March 2, 1990. He had placed between 30 and 40 junk cars on his property. These were in addition to several vehicles there awaiting repair. Mr. Goodwin agreed that he was in violation of his permit and agreed to correct the situation not later than April 10, 1990. He agreed with the date and said he could solve the problem with no undue hardship. He was sent a letter on March 5, 1990 to confirm the March 2nd meeting and eliminate any possible misunderstanding concerning the date and what he needed to do to get into compliance (attachment 4). During the period of March 2, 1990 to April 11, 1990 there was no contact with Mr. Goodwin so it was assumed he had no problem with our agreed upon requirements to bring his property into compliance with the conditional use permit. I inspected Mr. Goodwin's property on April 11, 1990 and found no substantial change in the number or condition of the vehicles located there. There are at least 25 inoperable vehicles located on the property. Based on the above stated facts I request that the Commission recommend revocation of Conditional Use Permit #011- 89 of Richard L. and Margaret D. Goodwin. 9 Court Square - P.O.
