CUP #010-89, Landscape and Lawn Service
Dear Mr. Turner:
On February 4, 2002, this office visited your property to check for compliance with the conditions
of the above referenced CUP. Upon inspection, it was noted that more adequate screening of stored
equipment must be provided along the western property line. Condition #4 of the approved CUP
states that equipment associated with the business must be screened from adjoining properties. As
you were present at the time of inspection, we mentioned this to you and you agreed to extend the
existing fence to screen the equipment.
Please find enclosed a copy of the approval letter stating all conditions of your CUP. If you have any
questions, please do not hesitate to call this office at (540) 665-5651.

Dear Eric:
This is to place a formal complaint on behalf of a client represented by this firm. As I
understand it, your office issued a conditional use permit to the Turners to allow them to store some
limited equipment associated with their landscaping business. I enclose photographs of the Turner
property which depict excessive storage of a multitude of landscaping type equipment and other junk
items, the totality of which I believe constitutes a violation of their conditional use permit. The junk
includes portable generators, lawn mowers and other items. There are also several large tanks which
appear to be the type used to hold fuel oils and other chemicals. Still further, the photographs depict
a significant amount of material immediately adjacent to the property line which we believe may be
a separate violation of the zoning ordinance.
I understand that your office will not investigate a violation of a conditional use permit
without a formal complaint. Please allow this to serve as such.

I have reviewed the information submitted with your July 17, 2001 letter referencing
Conditional Use Permit #010-89, Nick Turner Landscape & Lawn Service.
I have discussed this with Frederick County Planning Staff. It is their opinion
Mr. Turner has not intensified his operation as outlined in his Conditional Use Permit.
Based on the above information and the ambiguity of the VDOT statement that the
entrance may require reconstruction to minimum standards, VDOT is hesitant to require
entrance improvements of Mr. Turner at this time. However, should his operation
exceed the limits set Forth in CUP #010-89, VDOT will expect Mr. Turner to upgrade his
entrance.

ADJACENT LAND USE AND ZONING: Agricultural & vacant land uses zoned RA (Rural
Areas)'
PROPOSED USE AND IMPROVEMENTS: A landscape and lawn service, with pole barns for
equipment and a small barn (25' x 25') for equipment.
REVIEW EVALUATIONS:
VA Dept. of Transportation - No objection to conditional use permit for this
property. A commercial entrance may need to be constructed to our minimum
standards to allow for safe egress and ingress.
Health Department - No objections if no increase in water use. Only one
person has been working in his shop. Sewage system appears to be functioning
OK.

Frederick County Fire Marshal - I do not believe this use will create any
greater fire problem than other uses in the area. There is no water for
hydrants available. I see no problems, providing all requirements of the
Virginia State Fire Prevention Code are met.
Planning and Zoning - A CUP for a public garage has just been revoked on this
property due to an unresolved setback violation. Landscape contracting
businesses are permitted in the RA zone with a CUP.
STAFF RECOMMENDATIONS: Approval, with the following conditions:
1. This is a one-year permit to be reviewed and renewed annually by the staff,
the Planning Commission, and the Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes, this conditional
use permit shall expire and a new conditional use permit will be required.
3. Any existing setback violation be rectified prior to issuance of this permit.
4. Equipment used in conjunction with the business be screened from adjoining
properties.
5. That some limit be placed on the number of vehicles and/or employees used in
conjunction with the business.
