Dear Sir:
This letter is to confirm action taken by the Frederick
County Board of Supervisors at their meeting of June 14,
1989.
Approval of Conditional Use Permit # 007-89 of Perry Engineering
Co.,Inc. for Grove Shale Pit to be located on the west
side of Virginia Route 655, approximately three (3) miles
north of Route 50 in the Shawnee Magisterial District.
This conditional use permit is approved with the following
conditions:
1. This is a one-year permit to be reviewed and renewed
annually by the staff, the Planning Commission, and
the Board of Supervisors.
2. If the use, occupancy, or ownership of the property
changes, this permit shall expire and a new conditional
use permit shall be required.
3. Any new entrances onto public roads shall meet VDOT
requirements.
4. The EM site plan shall be reviewed and approved administratively
by staff.
5. Trucks are to maintain proper speed limits and mud shall
not be carried onto the highway.

LOCATION: West side of Virginia Route 655, approximately three miles north of US
Route .50.
MAGISTERIAL DISTRICT: Shawnee
ADJACENT LAND USE AND ZONING: RA (Rural Areas) zoning; agricultural and
residential land use
PROPOSED USE AND IMPROVEMENTS: Open mine shale pit
REVIEW EVALUATIONS:
VA Dept. of Transportation - No objection to conditional use permit. Sight
distance is adequate from present entrance. Entrance may have to be upgraded
to our minimum standards.
Sanitation Authority - No water and sewer service available.
Health Department - No objection; there has been no problem at present.
Fire Marshal - While open pit mining of shale poses no fire threat itself,
storage of explosives and/or fuel on site does. Any storage of these
materials will have to be approved and meet the requirements of the 1987 BOCA
and NFPA.
Planning and Zoning - A CUP is requested for shale mining on a 75+ acre tract
on Route 655 approximately 3 miles North of U.S'. Route 50. Some shale r°
removal has taken place at some point in the past. The applicant will be
removing shale above the mean grade level from an existing bank. The mining
will have to meet the following conditions: 1) All requirements of the
Virginia Division of Mineral Mining; 2) All landscaping and screening
performance standards, supplementary regulations, height, area and bulk
regulations and site plan requirements for the EM (Extractive Manufacturing)
District.
A 100 foot buffer is required around the perimeter of the property in which
mining cannot occur. The parcel consists of 75+ acres with the shale deposit
to be mined consisting of about a third and being situated toward the center
of the parcel.

The Board explained to Mr. Kessler that this had been
decided at an earlier meeting and had been forwarded to the
Department of Transportation.

Mr. Ed Lambert, County resident, appeared before the Board
and expressed his dissatisfaction with all that has been allowed
on Sulphur Spring Road and that it should be called "Dump Road".
He further stated that he had concerns about all the mud that
was being carried onto the highway as well as the speed from
these trucks.
Upon motion made by W. Harrington Smith, Jr., seconded by
Dudley H. Rinker and passed unanimously, conditional use permit
number 007-89 of Perry -Engineering Company, Route 6, BOx 152-B,
Winchester, Virginia, for an open mine shale pit was approved
;with the condition that- mud not -be carried--onto-the highway and/
that the trucks maintain.the proper speed limit..! This property
is located on the West side of Route 655, approximately three
miles North of U.S. Route 50 and is identified as Parcel 73-0 on
Tax Map 65 in the Shawnee Magisterial District.

RESOURCES OF WINCHESTER, INC. - STONEWALL MAGISTERIAL
DISTRICT - APPROVED
Mr. Watkins presented this request and stated that the Plan-
ning Commission recommended approval with conditions.
Mr. Jay Wetsel, Attorney, addressed the Board on behalf of
the Petitioner.
There was no opposition.
Upon motion made by Charles W. Orndoff, Sr., seconded by W.
Harrington Smith, Jr. and passed unanimously, conditional use
permit number 008-89 of Health Equity Resources of Winchester,
Inc., 1011 Pennsylvania Avenue, Winchester, Virginia, for a
personal care home was approved. This property is located at
1011 Pennsylvania Avenue and 1025 Pennsylvania Avenue in
