This letter,is to confirm the Frederick County Board of Supervisors' action at
their meeting of May 10, 1989:
Approval of Conditional Use Permit Request #006-89 of Perry Engineering Company
for shale mining above the existing mean grade level. This property is located
on the north side of Route 50, approximately two miles east of I-81, in the
..,Shawnee Magisterial District.
This conditional use permit is approved with the following conditions:
1. This is a one-year permit to -be reviewed and renewed annually by the staff,
the Planning Commission, and the Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes, this conditional
use permit shall expire and a new conditional use permit will be required.
3. New entrances onto public"roads shall meet all requirements of the Virginia
Department of Transporation.
4. Existing vegatation shall be maintained in the buffer areas adjacent to the -
side the rear boundaries.
5. The EM site plan shall be. reviewed and approved administratively by the
t staff.

east of Interstate 81
MAGISTERIAL DISTRICT: Shawnee
ADJACENT LAND USE AND ZONING: One residence and forestland zoned
A-2 (Agricultural General)
PROPOSED USE AND IMPROVEMENTS: Shale mining above the mean
existing grade level of the parcel.
REVIEW EVALUATIONS:
Transportation Department - No objection to the conditional
use permit for this property. Sight distance is adequate
from present entrance. Entrance may have to be upgraded to
our minimum standards.
Sanitation Authority - No comment.
Frederick County Fire Marshall - While open pit mining of
shale poses no fire threat itself, storage of explosives
and/or fuel on site does. Any storage of these materials
will have to be approved and meet the requirements of the
1987 BOCA and NFPA.
Greenwood Fire Company - No comment.
Inspections Department - Shall comply to Use Group
of the BOCA National Building Code 1987 at the time of
plans review to determine the use.
Planning and Zoning - A CUP is requested for shale mining
on land adjacent to the Perry Engineering headquarters.
Some shale removal began before the applicant realized that
a CUP.was required. Basically the applicant intends to
remove shale while maintaining the existing mean grade
level to allow future development.
The mining will have to meet the following conditions:
1. Such mining operations shall meet all requirements of
the Virginia Divisions of Mineral Mining.
2. Such mining operations shall meet the landscaping and
screening performance standards, supplementary regulations,
height, area and bulk regulations, and site plan
requirements contained in the requirements for the EM
(Extractive Manufacturing) District.
A buffer of 100 feet is required around the perimeter of
the property in which mining cannot occur. The site is
currently wooded over most of the parcel. Other EM
requirements will have to be met.
STAFF RECOMMENDATIONS: Approval with the following conditions:
1. This is a one year permit to be reviewed and renewed annually
by the staff, the Planning Commission and the Board of
Supervisors.
2. If the use, occupancy, or ownership of the property changes,
this conditional use permit shall expire and a new conditional
use permit will be required.
3. New entrances onto public roads shall meet all requirements of
the Virginia.Department of Transportation.
4. Existing vegetation shall be maintained in the buffer areas
adjacent to the side and rear boundaries.
5. The EM site plan shall be reviewed and approved
administratively by the Planning Staff.
PLANNING COMMISSION RECOMMENDATIONS OF 5/3/89: Approved, by the

10. Disposal of toxic materials
In order to protect the waters of the Commonwealth against pollution, all
toxic ores or mineral solids, such as iron pyrite, that are exposed following
mining shall be covered with a minimum of two feet of soil capable of supporting
a plant cover. If other method is to be used for handling toxic materials,
attach procedure to this plan.
11. Regrading
It is required that grading be done currently with the mining operation.
There are many good reasons for this practice. The soil is loose at this time
and more susceptible to erosion. By grading as soon as possible, an eyesore is
eliminated and a quick drainage pattern can be established.

Regrading: All spoil pile areas shall be graded in such a manner as to conform
with the surrounding topography. The stock pile areas will be graded down, or
as close to, the original contour surfaces so that vegetation can be establisMe-cE.
Top soil will be piled in a convenient location so that it may be graded ac
over the mined -out area. Any remaining areas, loose soil, refuse, and other
debris will be graded and reduced in accordance with good conservation practices.
12. Water Impoundment
Where the operator elects to impound water to provide lakes or ponds for
wildlife, recreational or water -supply purposes, such operator shall file a
formal request with the Department and obtain approval before such ponds or
lakes can be created in impounding such water. In no event shall any small
pools of water that are likely to become noxious, odious, or foul and likely
to become breeding places of undesirable insects be allowed to exist. In any
case where this condition exists, suitable drains or ditches or conduits shall
be constructed or installed to avoid such conditions. All lakes and ponds
shall be considered reclaimed lands when approved by the Division.

B. Haul Road: The banks shall be graded and vegetated to establish good
drainage. Crossbars and culverts shall be installed where needed for
nroner drainage.

After stock piles are removed and grading completed, all areas will be
harrowed, limed, and tertilizedin accordance with soll testsfor establishtng
vegetation. The sowing of grasses and legumes and the planting of tree and shrub
seedlings will be in accordance with the Division of Mined Land Reclamation's
vegetation guidelines as to rate and species unless otherwise approved by the
Division.
18. Attached to this plan are two copies of a map or aerial photograph showing
details of proposed operation with acreage involved. These maps are intended
to be a part of this plan. The maps were prepared by: Greenway Engineering
Company, Inc
19. The operator hereby agrees to comply with this plan and to furnish such reports
and information which are required. The operator also agrees to explain this
plan in detail to all of his employees who will have a part in carrying out his
plan.
This plan must be reviewed in detail with either an inspector in the field or
authorized personnel at the Division of Mined Land Reclamation Office in Lynch-
burg, Virginia.
This plan of reclamation is approved with the understanding that the Division
of Mined Land Reclamation may require amendment or revision at a later date
after having the opportunity to examine the site and the plan for reclamation
in greater detail.
