It has come to my attention a large sign advertising your facility has been constructed
on VDOT property. Attached for your information are copies of plans showing VDOT
property in the general area of this sign.
Please be advised VDOT does not permit signs to be placed and/or constructed on its
property. It will be necessary for you to make arrangements to have this sign removed.
Thirty days from receipt of this letter should allow ,you ample time to do so.
Should you have any questions regarding this matter, please do not hesitate to call.

Dear Mrs. Anderson:
This letter is to confirm the Frederick County Board of Supervisors' action at
their meeting of March 8, 1989:
Approval of Conditional Use Permit #013-89 of Cheryl L. Anderson for an
off -premise sign to be located at the intersection of Route 11 and Route 836, on
the southeast corner, in the Gainesboro Magisterial District, with the following
conditions:
1. This is a one-year permit to be reviewed and renewed annually by the staff,
the Planning Commission, and the Board of Supervisors.
2. If the use of the property changes, this conditional use permit shall expire
and a new conditional use permit will be required.
3. Obtain the necessary local and state permits.
If you have any questions regarding your conditional use permit, please do not
hesitate to call this office.

ADJACENT LAND USE AND ZONING: A-2 (Agricultural General) zoning,

PROPOSED USE AND IMPROVEMENTS: Off premise sign
REVIEW EVALUATIONS:
Transportation Department - In accordance with the laws of
the Commonwealth of Virginia, no private sign can be placed
within the State's right-of-way. Prior to erection, a
permit will have to be applied for through our District
Office in Staunton.
Inspections Department - This request for a conditional use
permit for an off -site sign shall comply to Section 290.00
of the BOCA National Building Code 1987. Requirement for a
permit would be 2 sets of plans, a plot plan of location of
the sign, and Virginia Engineer's Seal on plans for the
footers. If it is a lighted sign, need input amps, UL#,
and electrical permit.
Planning and Zoning - Proposed sign location is within
State's right-of-way for Routes 11 and 836.
STAFF RECOMMENDATIONS: Approval, with the following conditions:
1. A one year permit to be reviewed and renewed annually by the
staff, Planning Commission and Board of Supervisors.
2. If use, occupancy, or ownership of property changes, this
conditional use permit shall expire.
3. Obtain the necessary local and state permits.

This permit does not grant permission for removal or trimming shrubs or trees on the highway right of way. Violators will be
prosecuted.
A PERMIT is NOT VALID except when identification tag is attached to the sign. When the sign is owned by a LICENSED
OUTDOOR ADVERTISER, it shall also bear his name.
AN ADVERTISING SIGN MUST NOT BE ERECTED UNTIL A PERMIT IS ISSUED FOR IT.
Permits expire on December 31, following date of issue and must be renewed within thirty days.

SPACING OF STRUCTURES - Interstate Highways and Freeways on the Federal -aid Primary System
No two structures shall be spaced less than 500 feet apart.
At the intersection of any Interstate Highway and any other highway, no structure shall be
permitted within 500 feet from any point of ingress to or egress from the Interstate Highway.
Federal -Aid Primary Highways
No two structures shall be spaced less than 300 feet apart.
For the purpose of these regulations an unzoned commercial or industrial area shall be defined as a parcel or
parcels of land on which there is located one or more permanent structures devoted to a business of industrial
activity or on which a commercial or industrial activity is actually conducted, whether or not a permanent structure
is located thereon, and the area extending outward 500 feet from and beyond the edge of such activity. Each side
of the highway will be considered separate in applying this definition.
