Dear Mr. Gill:
This letter is to confirm the Frederick County Planning Commission's action at
their meeting of June 21, 1989:
Approval of Conditional Use Permit #004-89 of William E. Gill for a cottage
occupation/heating and air conditioning business located on Route 852 in the
Gainesboro Magisterial District, with the following conditions:
1. This is a one-year permit to be reviewed and renewed annually by the staff,
the Planning Commission, and the Board of Supervisors.
2. If the use of the property changes, this conditional use permit shall expire
and a new conditional use permit will be required.
3.. No exterior storage of parts and equipment, unless screened from surrounding.

REVIEW EVALUATIONS:
VA Dept. of Transportation - No objection to conditional use permit for this
property. If use should ever expand, entrance may need to be upgraded.
Health Department - No objection to present use. No water to shop. No
health problems noted.
Sanitation Authority - Water and sewer not available.
Fire Marshal - This CUP would not create any unusual circumstances for the
fire department. Mr. Gill would be responsible for adherence to the
Statewide Fire Prevention Code.
Inspections Department - This CUP shall comply to Use Group "M" Mercantile,
Section 308.0 of the BOCA National Building Code 1987.
Planning and Zoning - The application was tabled at the last Planning
Commission meeting as no one was present to represent the application.
Mr. Gill has been operating a heating/air conditioning business out of his
home for sometime. Complaints were received which were investigated,
resulting in this application for a conditional use permit.
STAFF RECOMMENDATIONS: Approval, with the following conditions:
1. This is a one-year permit to be reviewed and renewed annually.
2. If the use, occupany, or ownership of the property changes, this permit shall
expire and a new conditional use permit shall be required.
