This letter is to confirm the Frederick County Board of Supervisors' action at
their meeting of January 9, 1985:
Approval of Amended Conditional Use Permit #022-80 of Thomas L. and Barbara
Conrad to amend the conditions on the existing Conditional Use Permit
#022-080 located one mile south of Stephens City on the east side of Route 11,
known as Bon Air Home for the Elderly, Inc. in the Opequon Magisterial District
with the following conditions:
1. This permit shall be reviewed annually by the staff, Planning Commission, and
Board of Supervisors to insure compliance with the terms of the Conditional
Use Permit.
2. If the use of the property changes, this conditional use permit shall expire.
3. The applicant shall promptly inform the Department of Planning and Development
of any changes in the occupancy or ownership of the premises.
4. A site plan must be submitted before any further expansion.
NOTE: The above conditions deviate from the normal conditional use permit
conditions in order for the applicant to acquire financing for expansion.
This is the primary reason for allowing these open-ended conditions and
should not be considered as a precedent setting situation

AMENDED CONDITIONAL USE PERMIT #022-80

LOCATION: One mile -south of Stephens City on the east side of Route 11, known
as Bon Air Home for the Elderly, Inc.
MAGISTERIAL DISTRICT: Opequon
ADJACENT LAND USE AND ZONING: Residential and open space land use and
agricultural and residential zoning.
PROPOSED USE AND IMPROVEMENTS: Amend the conditions on the existing Conditional
Use Permit #022-80.
REVIEW EVALUATIONS:
Highway Department - No objections; however, .with the proposed addition, it
is felt that the sub -standard entrance should be reconstructed to be
brought to our minimum commercial entrance standards at this time.
Health Department - No objections as long as the criteria listed in the
attached letter to Herbert L. Sluder from Harold T. Eberly, District
Engineer for the Division of Water Programs, State Department of Health,
are met.
Planning and Zoning - Enclosed you will find a copy of the existing
conditions on this conditional use permit. That permit would expire on
December 10, 1985, if no changes were made. The Conrad's, for a variety of
reasons, have found it difficult to implement their expansion plans under
these conditions. In February of 1984, they applied to the Commission for
a rezoning of this property. The Commission recommended denial of that
rezoning and the Conrad's withdrew the application.
The staff has since written to Mark Conrad suggesting the following
conditions:
1) This permit shall be reviewed annually by the staff, Planning
Commission, and Board of Supervisors to insure compliance with the terms
of the Conditional Use Permit.
2) If the use of the property changes, this conditional use permit shall
expire.

3) The applicant shall promptly inform the Department of Planning and
Development of any changes in the occupancy or ownership of the
premises.
Mr. Conrad has accepted these conditions.
STAFF RECOMMENDATIONS: Approval; the conditions insure compliance with the
intent of the permit and give the applicant the flexibility he needs.
PLANNING COMMISSION RECOMMENDATIONS: Unanimous approval with the following
conditions:
1) This permit shall be reviewed annually by the staff, Planning Commission,
and Board of Supervisors to insure compliance with the terms of the
Conditional Use Permit.
2) If the use of the property changes, this conditional use permit shall expire.
3) The applicant shall promptly inform the Department of,Planning and Development
of any changes in the occupancy or ownership of the premises.
4) A site plan must be submitted before any further expansion.
NOTE: The above conditions deviate from the normal conditional use permit

I apologize for the delay in preparing this proposal for your review. Based on
our telephone conversations a number of months ago, I would like to submit the
following proposal for a, set of conditions to be placed on a conditional use
permit for the Bon Air Home for the Elderly.should an application be submitted
to this office. Please review these conditions and.inform me of any suggestions
or comments you may have. .When and if we can agree on a set of conditions that
you feel you would like to propose to the Planning Commission, I would propose
that you submit an application for a conditional use permit through this office
to the Planning Commission.and Board of Supervisors.
1. This permit shall be reviewed anhually.by.'the staff, Planning Commission, and
Board of Supervisors to insure compliance with the terms of the conditional
use permit.
2. If the use of the property changes, this conditional use permit shall expire.
3, The applicant shall proMptly inform the Department of Planning and
Development of any changes in the occupancy or ownership of the premises.
I have no idea as to whether these conditions would be acceptable to the
Planning Commission and Board of Supervisors. If you feel that they would meet
the requirements that Bon Air Home for the Elderly would have in terms of their
conditional use permit application, I would propose that we schedule an informal
meeting before the Planning Commission to ask them their opinion of these
proposed conditions. If you have any questions concerning this letter, please

MAGISTERIAL DISTRICT: Opequon Magisterial District.
ADJACENT LAND USE AND ZONING:
Residential.
PROPOSED USE AND IMPROVEMENTS:
. Expand existing use to include a total of 120 bed medical
care facility.
REVIEW EVALUATIONS:
Va. Dept. of Highways and Transportation/Public Works - If any
changes,are proposed in the entrances, a permit must be secured
from the Va. Dept. of Highways and Transportation before any work
is performed on State right-of-way.
Frederick -County Sanitation Authority - Sewer is presently
provided through the Stephens Run Treatment Plant. Capacity is
available for the expansion.
City of Winchester - There is an existing 8 inch fire service on
this property and domestic water service is available.
Department of Inspection - Must conform to Use Group I, Section
207.0, Article I of the Code. Specific requirements will be
noted on plans.
Frederick -Winchester Health Department - Health Department has no
objection as the sewage system is adequate to serve the proposed
expansion.
Zoning - No objection. A site development,plan will be required
before building permits are issued.
Planning - Satisfactory. Applicant is expanding a permitted use
allowable under a conditional use permit in an Agricultural Zone.
Suggest the following conditions be discussed:
1. -This be a five year permit to be reviewed annually by the
staff.
2. Suggest items such as the placement of screening and
lighting may be required at the time the site plan is
submitted for approval.
3. Suggest discussion with applicant to determine normal hours
of operation.
STAFF RECOMMENDATIONS:
Approval with conditions suggested under planning.
PLANNING COMMISSION RECOMMENDATIONS:
The Planning Commission unanimously recommends approval to the
Board of Supervisors of Conditional Use Permit #022-80 with the

Sewerage: Bon Air Home for the Elderly
This is in response to your September 12, 1980 request for this office's comments
regarding whether or not sufficient capacity exists in the Bon Air Home sewage
pumping station to handle an expansion of the Bon Air Home of the size contained
in Mr. Conrad's rezoning request. It is this office's understanding that the
proposed increase will expand the facility to an ultimate size of between 120-
160 beds.
As discussed, the Bon Air pumping station is presently rated to handle an average
flow of 12,500 gallons per day or an equivalent population of 125 persons at 100
gallons per day per capita with the station capable of handling a maximum flow of
70,560 gallons based on a peak factor of 5.6. Based upon our evaluation, it is
this office's opinion that the Son Air pumping station can adequately handle waste-
water from a facility with a maximum size of approximately 154 beds, 108 staff
members, (3 shifts at 36 employees per shift), and 3 residential connections. This
opinion was made based on the following criteria: (1) 100 gallons per day per bed;
(2) 10 gallons per day per shift employee; (3) 400 gallons per day per residential
connection; and (4) a reduction of the peak factor to 2.5. An expansion beyond
that outlined above may necessitate expansion or upgrading of the pump station. It
should be pointed out that under current state regulations once a facility reaches
80 percent of its design capacity the owner of the facility is required to declare
his intentions as to whether or not it is intended to expand the facility beyond
the existing design capacity. If expansion is contemplated, plans and specifications
must be developed, submitted, and approved prior to the facility reaching 95 percent
of its capacity; otherwise, no additional connections or usage above the 95 percent
mark is permitted.
With regard to the water supply, this office has very little, if any, information
concerning the well presently being utilized by the Bon Air Home for water supply.
Therefore, it is this Department's feeling that since central water is readily
available at the Home, this should be utilized rather than the existing well source
if the facility is to be expanded as outlined.
