LONG Star Staff Writer They came to express fears of motors revving up at 6 a.m., of trucks hitting telephone poles on their lawns, of gasoline and oil runoff collecting and seeping into their homes. And they won a tentative victory. Eight homeowners spoke against a conditional use permit request presented to the Frederick County Plan- ning Commission yesterday by Road- way Express Inc., which wants to locate a motor freight terminal on the south side of Shawnee Drive, across from nine residences. Three hours later, six planners voted against the request, and one abstained. Planner Frank Brumback said he would abstain because he wanted to see a site plan outlining specifics of the truck ter- minal planbefore taking a vote. The issue will be referred to the Frederick Supervisors for final action. ROBERT MITCHELL, attorney for Roadway, argued that the location of land in question — 3.6 acres zoned heavy industrial next to the Winchester In- dustrial Park, in an area zoned for business and industry — makes it an ideal spot for a motor terminal despite its residential character. He said traffic congestion in the area wouldnot be increased by the terminal, because the same trucks will travel through on their way to the Winchester Industrial Park whether or not the con- ditional use permit is granted. The only difference, he said, is that they will not stop to load and unload if the permit is not granted. The number of trucks involved in the operation, Mitchell said, would be 10 in- itially, and would grow to no more than 15 to 18. Two trucks would bring goods from Hagerstown, Md., to the terminal. The goods would then be transferred to local trucks and tractor trailers for delivery to local industries. THE RESIDENTS were particularly Winchester Evening Star 17 Thursday, April3, 1980 tractive manufacturing to operate a sand mine, came to protest at the six - hour meeting yesterday. The planning commission tabled ac- tion on the request.Kenneth Stiles, supervisor liaison to the commission, told Nicholson that the rezoning applica- tion might be considered if he can show that the operation will be limited in scope and will not abut any residential properties. The land is located off Rt. 55 and near its junction with Rt. 608. The commission asked Nicholson to return with a more detailed description of the boundaries of land he wants rezon- ed. The entire parcel amounts to 187 acres, but some members of commis- sion feels only about 14 acres should be considered for rezoning. Planner Jim Golladay Jr. commented that if 14 acres of agricultural land are upzoned for heavy industrial or extrac- tive manufacturing use in that non- concerned with potential effects on their already aggravated drainage problems. They argued that water from the north side of Shawnee Drive already drains onto their land and leaves pools of water which, afterheavy storms, seeps into their homes. Stan Pangle, county director of public works, said that the permit could be ap- proved under the condition that the water problems in the area are solved before the terminal is allowed to operate. Attorney Mitchell said ponds would be built to collect excess runoff, and grass bales would be used to absorb gas and oil spills. Residents also expressed concern that the value of their homes would drop as a result of the terminal's location across the road. One woman said the planners had considered downzoning the residen- tial land two years ago and asked why the land had not been downzoned along with other county land.She was told that the commission is hesitant to downzone land which a property owner is actively petitioning to use in line with the current zoning. Another property owner commented, "I'd just as soon be zoned industrial," if the terminal plans go through, "other- wise what will we ever do with our homes?" CITIZENS IN an agricultural region of the Back Creek District, where developer Albert Nicholson wants a parcel rezoned to heavy industrial or ex - industrial area, "it would be feasible to rezone the whole thing (187 acres) later on.... If we rezone it we've established a precedent in that area." On April 9, 1989, the Defendant 'Boars of Supervisors gave final approval to the pro- posed subdivision. On June 13, 1980, than Planning Commission gave final approval to the Complainant's site davelopment plan. .J is 3. On April 2, 1933, the Planning Commission recommended to the board of 5apervisors that the Complainant be denier: the use of the property for the proposed permitted use by reco=ending Y, that the conditional use permit application be denied. 9. The Complainant objected to the foregoing recommendation of the Planning Commission on the ground that the County was without authority to deny to the Complainant a use of the pro- perty which is specifically permitted by the Zoning Ordinance. Reely SECRETARY Re: Legal Opinion Concerning Request by Roadway Express for a Conditional Use Permit Gentlemen: The issue has been raised by one or more members of the Frederick County Planning Commission whether the Board of Supervisors has the discretion to approve or deny a Conditional Use Permit, and if so, may it exercise such discretion with reference to the above -captioned application. The Code of Virginia, the Code of Frederick County and recent Virginia cases on the issue of whether the Board of Supervisors may exercise discretion in approving or denying a Conditional Use Permit make it clear that the.Board does have such dis- cretion since this would be a legislative function of the Board and in such capacity the Board has broad discretion. In the above -captioned matter, however.,.we are dealing with a different situation. Since Section 21-127(a) of the Code of Frederick County, provides that a truck terminal is a permitted use in M-2 Zoning, Roadway Express would therefor have the right to use the property in question for a truck terminal, subject to Section 21-1-28 of said Code,.which provides that such permitted uses as set forth in Section 21-127 may be subject to a Conditional Use Permit as recommended by the Planning Commission and imposed by the Board of Supervisors. In other words, Roadway Express by virtue of Section 21-127 has the right to use their M-2 Zoned land for a truck terminal and the Planning Commission has the discretion to recommend and the .Board of Supervisors the discretion to impose certain conditions on that use. Denial of a Conditional Use Permit under these 0 0 -)- ---d% v The Frederick County Planning Commission Page 2 June 18, 1980 circumstances would mean that Roadway Express would be permitted to construct a truck terminal without any conditions attached whatsoever. The aforementioned situation may not have been intended or contemplated by the local governing body when enacting the current zoning ordinance. However, the way said ordinance now stands, a truck terminal is permitted as a matter of right in M-2 Zoning. If it is intended that a truck terminal be permitted only with a Conditional Use Permit, then it would be my recommendation that the Ordinance be properly amended. Andre' Re: Roadway Express Conditional Use Permit Dated: June 20, 1980 After the Planning Commission's hearing on Roadway, I asked John Horne to provide me with a copy of the conditions as finally expressed'by the Commission. He has done.so and I have reviewed the same. The following are my recommendations with the changes underlined in red and the explanation in parenthesis there- after. 1- 1. Adequate screening along the front and sides of the property shall be installed and maintained by the occupant. 2. Directional lighting shall be installed in such a manner so as to direct light away.from all adjacent properties. 3. Storm water runoff shall not exceed pre -development runof f rates and guano, tin es • (The change I have made is by adding "and quantities". I believe rates would apply to the gallons per minute which may or may not change. I believe that the Commission intends.to limit those gallons per minute and overall quantity.) 4. If the use is discontinued, or occupancy of the building changes, this conditional use permit shall expire and a new conditional use permit will be required. 5. This is a five year conditional use permit to be reviewed by the staff and Planning Commission annually for determination of c"om lice w� ith these conditions an_dw to cones ide; addin removing conditiong Upon the expiration of this eermit a new one will be required. (The change is the addition of everything after the word "annually". I think there should be a stated purpose for the annual review, and while it may not be permissible I believe that a strong case can be made for adding as a condition now the possible imposition of conditions later in the light,of experience and changes.. Obviously, the Commission and the Board will be subject to a reasonableness test in doing so. I have added the possibility of removing some conditions so as to meet the thrust of an argument that our conditions are patently one-sided. Also, if we do not require a new permit in five years, upon the expiration of this one.Roadway could operate the Terminal with -no conditions.) 6. There shall beano travel from itsp rcel to an adjoining ar�cel nor from an adjoining arc l to this one. (This one is completely rewritten. .I believe it was the intent of the Commission to prohibit the expansion of this business to adjoining parcels or the joining with it of businesses on other parcels. Perhaps I am simply too suspicious, but Bob Mitchell's suggested change at the last moment which is shown.as paragraph 6 of that recommended to me means or could be construed to mean simply that Roadway's property may not be used as the route by which other parcels are reached, or other parcels reach Shawnee Drive. In other words, it would prohibit its use as the servient tract, but would not prohibit travel between it and other parcels.) 7. There shall be no truck traffic in or out of the Terminal - 2 - or on the Terminal property between 1.0:00 P.M. and 6:00 A.M., Monday through Saturday, nor at any time durin Sunday. (My changes were done simply to clean up the language used, and in my view make no substanative change.) 8. Total building size shall not exceed 7,133.5 square feet. (I know the 'intent of the commission is to limit the total building size and I believe that the way they recommended approval could be construed -to mean that expansion could be an additional 7,133.5 square feet.)
