This letter is to confirm the Frederick County Board of Supervisors'
action at their meeting of January 11, 1984:
Approval to amend Conditional Use Permit #021-79 of Ralph W. Poe/
Candy Hill Campground, located at the end of Ward Avenue on Virginia
Route 1317, by the addition of a Vehicle Sales Use with the
following conditions:

B. The following conditions are placed on the conditional use permit:
1. No A.B.C. license.
2. No firing range.
3. Hours of operation from 7 a.m. to 11 p.m.
4. Camping spaces to be utilized only for bona fide campers (Maximum
length of stay 4.weeks).
5. No auto, motorbike, go-carts, or snowmobile trails in camp area
or the use of such off -road vehicles for recreational purposes in
the camp area. The camp area is defined on the site plan (47.65
acres as advertised).
6. The owner shall furnish a list of proposed restrictions to be
imposed.
7. Recreation facilities are restricted to the use of campers only.
8. There shall be no more than seventy (70) campsites as provided on
the site plan.
9. This conditional use permit shall be reviewed annually by the
staff provided that no changes take place on the site and that
all conditions placed on this permit are met. If any condition
is violated, it shall constitute grounds for immediate revocation
of the conditional use permit.
10 If the property changes use, occupancy, or ownership, a new
conditional use permit will be required.

OUR RULES FOR SAFETY AND ENJOYMENT
1. FIRES are permitted almost anywhere on your site.
Keep safety in mind and drown it before abandoning
it.
~ 2. WASTEWATER is not permitted on the ground in
Virginia (state law).
3. PETS should be leashed at all times. YOU are
responsible for your pet.
4. MOTORCYCLES may be ridden IN and OUT only. No
riding around premises. Trails have been ordered
closed by Frederick County Board of Supervisors.
5. SWIMMING is permitted for registered campers only.
6. FISHING is permitted for registered campers only.
�\\ No license required. Walk through the small gate
behind the bath house and over the hill to lake.
7. ALL VISITORS must stop at the office each time in.
No charge for a short one hour visit. Visitors do not
have the privileges of our campers.
8. WATER should always be conserved anywhere. It is
one of our natural resources, AND we are supplied
by a well.
9. ELECTRICITY is energy. Use what you need only.
Electric heaters are not permitted. We monitor each
hook-up.
10. COURTESY is contagious. Give your neighbor yours.
11. WOOD is available at our store. NEVER cut a tree
or limb or shrub without first obtaining authority
from the management.
12. TRASH should be placed into one of the large con-
tainers.
13. CAMPING at Candy Hill is limited to four weeks per
stay by order of Frederick County Board of
Supervisors. However, you may return as soon and as
often as you can.
14. CLOTHESLINE permitted for swimwear only.
15. ROADS must be kept open at all times for that
i emergency that we hope never occurs.
16. ALCOHOLIC beverage permitted only on your site.

SUBJECT: Conditional.Use Permit #021-79 Ralph W. Poe, Campground
DATE: May 7, 1982
I have reviewed the permit and conditions on this conditional use
permit in light of recent events involving Mr. Poe at his campground.
Upon review of those conditions, it is my position that the only .
possible violation would be of condition #7 in that, I would imagine,
some of the people who were involved in the incident were not camp-
ing at that campground. I do not believe that any of the other
conditions were violated and it would be the position of this office
that if this one time violation of condition #7 were corrected, that
there would be no reason to revoke the conditional use permit for
this use.
It is the philosophy of the Planning Department to work with all
applicants for conditional use permits to enable them to comply with
the conditions of a permit and I would not support a move at this
point to revoke this permit for this relatively minor violation. I
believe.that given the size of the investment that Mr. Poe has made
that such an action would be clearly unjustified and possibly illegal.
If you have any questions, please do not hesitate to contact me. I
have enclosed a copy of the conditions in place at this time on this
conditional use permit.

Sale of Travel Trailers & Recreational Vehicles
LOCATION: End of Ward Avenue (VA. Route 1317) between Interstate
Route 37 and US Route 50 West.
MAGISTERIAL DISTRICT: Back Creek
ADJACENT LAND USE AND ZONING: Agricultural, open space, and
residential land use and agricultural zoning.
PROPOSED USE AND IMPROVEMENTS: To amend Conditional Use Permit
#021-79 to allow the sale of travel trailers or recreational
vehicles at the Candy Hill Campground. Total trailers and/or
recreational vehicles for sale on the site would be limited to six
(6) at any one time.
REVIEW EVALUATIONS:
VA. Dept. of Highways & Transportation - Department of Motor
Vehicles' DMV license required. 250 square feet of office
space is required; a.sign, legible from the road, is required;
DMV license would also allow sales of other used or new
vehicles.
Department of Inspections - Any structures or construction must
meet the requirements of the Virginia Uniform Statewide
Building Code and be built under permit.
Health Department - No objection.
Planning and Zoning - Site plan must be amended to clearly
designate vehicle display and sales area.
STAFF RECOMMENDATIONS OF 11/2/83: No objection; Commission action
should be to amend existing permit conditions to directly state its
approval of this use; recommend that all RVs must be in running
condition at all times and limited to no more than 6 (six) on site
at any one time.

I am replying to your letter dated November 20,.1979 regarding the
septic tank and drainfield installation at the Candy Hill Campground.
This system was installed in 1974. Because it involved a rather
extensive drainfield-septic tank arrangement, assistance on the design
of the system was requested from Mr. Bernard Shutt, who was Regional
Sanitation Supervisor? -Virginia State Department of Health, at the time
the:sewage disposal permit.was.issued. You can be -assured that.the
specific designs --are in compliance with -:the sanitation.standards'of the
Health Laws of Virginia. I have every reason to have full confidence in
the design, because this is the nature of the experience and expertise
of our regional sanitation office. Significantly, there is no evidence
of the failure of the drainfield system, which is prima --facie evidence
of the adequacy of the design.
Mr. Pangle, State Health Department Rules and Regulations require
that the septic tanks "be of an approved design as to length, width and
depth or other pertinent dimensions so as to effectuate extended use,"
and "minimum size of a septic tank shall be based upon a retention period
of not less than 30 hours." The Rules and Regulations do not prohibit
use of tanks constructed from concrete block, as Mr. Eldon Frye maintains.
Actually .the Rules and. -Regulations provide in general--for-the-use of -poured---
in place, precast,.and metal septic tanks. Under certain conditions, other
types of tanks may be used, for example, .tanks constructed of concrete
blocks. Personally, I would much rather have a well built concrete block
tank than a metal tank, which will eventually rust and corrode.
Regarding the amount of drainfield, I explained to the Board of Super-
visors, and others, at the November 14, 1979 meeting that the bathhouse
facility was designed on the basis of 50 gallons per campsite, as about 50
percent of the spaces would have their own sewer hookups to other sewer
systems, therefore, there would be no need to design this facility on a
100 gallons per campsite basis. Four drainfield systems have been in-

stalled in the campground area. The systems are for the bathhouse, the
dumping station, and two complete systems for individual trailer hookups,
with a total of almost 8000 square feet of drainlines.
Based on the records and information on file, Mr. Hobart Bodkin,
present Regional Sanitatiion Supervisor of the State Department of Health,
is of the opinion that the sewage disposal systems as designed and in-
stalled are proper and satisfactory. In campground operations, additionally,
there are long periods of time when there is minimal use of campground
facilities, and provides the sewage systems with periods of rest and re-
juvenation.

The Northwest Regional Office has reviewed the septic tank permit,
and the sewage disposal system serving the bath house at the above
mentioned Campground.
A valid permit was issued for the installation of this septic
tank and drainfield, and the system was inspected when installed and
approved by the Frederick County Health Department.
This is an approved system until a malfunction occurs.

their November 7, 1979 meeting by a vote of five in favor, one abstaining and one not
in favor.

problem at the intersection of Routes 50 and 131i7,; reccmunends
that the campground does not utilize the prop--ty east of Route 37
for any campground related uses. Recommends detailed soil study
of -the septic and drainfield area due to limestone outcroppings.
Soil Conservation Service -- Areas that are: directly affected by- .
the septic drainfield system are classified as i oderate to severe
limitations. The moderate limitations can be overcome by modified
design or through installation of practices designed -to overcome

State Water Control Board - The State Water Control Board notes
that this area is characterized by carbonate rock areas.
Carbonate rock areas are subject to ground water pollution,
especially where adequate soil cover is not present. The State
Water Control Board further states that this in no way implies
that all carbonate rock areas contain contaminated ground water
and that responsible ground water management and development
programs are essential when considering land. uses in -carbonate
rock terranes.

The potential for ground water pollution does oexist as evidenced
by the State Water Control Board and. the Soil (Conservation Service
comments. This condition axists in any liirzestone 'outcropping
area. Preventive measures have been taken witih the installation
of an adequate septic and drainfield system_ 'This installation
was supervised'by Health Department officials.. The Health
Department also noted that adequate soil depth, was present in the
septic and drainfield areas and that no blast„ g to remove rock
was necessary. Copy of designed system is in ithe.file.
Virginia Department of Highways is satisfied that the existing,
traffic patterns and flow will not be adversely affected by this
proposal.
Impact on adjacent residential uses from this existing facility
can be minimal, if the applicant meets -the required conditions
of this permit. The conditions placed on this permit will be.
designed to promote harmony and reduce the impact on confr _T1g
land uses.

Conditional Use Permit for a Campground adjacent to Merriman's Estates and
the Ward Avenue Community. It unfortunate that this development was
initiated some five years agol !t is even more unfortunate that it has
been allowed to progress to its present stage without proper permits and
contracts. It should be obvious that this situation is a serious reflection
on our community.
The residents and land -owners of this area compliment the previous
actions of the Planning Commissi-ii in its efforts to protect the area from
unnecessary problems and to encourage orderly development. You are well
informed as to the hazards of water pollution, disturbing noise, traffic
problems, and policing requirements.
We should like to ant i(.ipate the possibility that. this Honorable
Commission will continue to support its previous actions and protect the
community from further undesi.rabh- developments.
In the event that you --ee fit to recommend a different course of

I am in receipt of your letter requesting confirmation of the information con-
tained in a letter to Mr. Ronald Berg dated March 5, 1976. This information
was in relation to a site proposed to be used as a campground.
The information contained in my original letter has not changed. The geology
and soil conditions remain the same, and�the basic characteristics of the
rock in that area (i.e., the susceptibility of limestone formations to
solution activity) remain unchanged. As noted in that letter, carbonate rock
areas are subject to ground water pollution, especially where adequate soil
cover is not present. However, this in no way implies that all carbonate
rock areas contain contaminated ground water. It simply means that responsible
ground water management and development programs are essential when considering
land uses in carbonate rock terranes.
Please be advised that I am taking no position either in favor of or in
opposition to this campground application. I am simply providing a,brief
outline of the basic geologic.setting and geologic principles. An article
in the florthern- Virginia Daily dated Thursday, May 27, 1976, cited the
State Water Control Board as stating "the campground coA'contaminate ground
water there':'.` This statement was not made in my letter of March 5, 1976.

Enclosed is a soils map of Candy Hill Campground which was made from
a soil survey field sheet. The ratings of the soils for the present and
proposed uses along with explanatory definitions is also enclosed. The ratings
given are not suitability ratings but limitation ratings; most sites can
be made suitable for a particular use with the expenditure of enough money
and resources to overcome the limitation. The interpretations do not
eliminate the need for on -site study, testing and planning of specific sites
for the design and construction for specific uses.
It is not permissable for this office to give opinions as to ground-
water contaminations, however, I would direct your attention to the definitions
of slight, moderate and severe ratings. In making a visual examination of
the campground, it is evident that the site limitations were considered
before designing or installing any components of the campground. Extra
expenses were incurred in covering rock outbreaks to make mowing possible,
concreting road surfaces, and in installing an elaborate septic drainfield
system. These are the types of measures that allow moderate and severe
limitations to be overcome.

Soils Interpretations:
Carbo Series: The Carbo Series consists of moderately deep, well drained
soils on uplands. They formed in material weathered from limestone with
some shale. Typically these soils have a brown silty clay loam surface
layer 6 inches thick. The subsoil from 6 to 9 inches is strong brown silty
clay loam, from 9 to 21 inches is yellowish brown clay, and from 21 to 26
inches is strong brown silty clay. The substratum from 26 inches to bedrock
at 36 inches is silty clay loam material and weathered rock, slopes range
from 2 to 30 percent.
Chilhowie Series: The Chilhowie Series consists of moderately deep, well
drained soils on uplands. They formed in material weathered from bedrock.
Typically these soils have a dark brown silty clay loam surface layer 5
inches thick. The subsoil from 5 to 13 inches is strong brown clay. The
substratum from 13 to 25 inches is strong brown very channery clay. Calcareous
interbedded shale and limestone is at a depth of 25 inches. Slopes range
from 0 to 45 percent.
Frederick Series: The Frederick Series consists of deep, well drained soils
on uplands. They formed in residuum derived mainly from dolomitic limestone.
Typically these soils have a brown silt loam surface layer 7 inches thick.
The subsoil from 7 to 14 inches is strong brown silty clay loam and from
14 to 70 inches is mottled yellowish red clay. The substratum from 70 to
95 inches is mottled yellowish red silty clay. Slopes range from 2 to 60%.
Massanetta Series: The Massanetta Series consists of moderately well drained
soils on narrow bottomlands along creeks and branches. The surface layer is
brown silt loam. The subsoil is yellowish -brown or light olive brown silt
loam with mottles. Slopes range from 0 to 3 percent.
Opequon Series: The Opequon Series consists of shallow, well drained soils on
uplands. They formed in material weathered from limestone. Typically these
soils have a brown silty clay surface layer 6 inches thick. The subsoil from
6 to 11 inches is yellowish red clay and from 11 to 16 inches is red clay.
Limestone bedrock is at a depth of 16 inches. Slopes range from 3 to 50%.
Timberville Series: The Timberville Series consists of deep, well drained
soils of the limestone valleys. They formed in alluvium from the surrounding
uplands. Typically these soils have a yellowish brown silt loam surface layer
8 inches thick. The subsoil from 8 to 36 inches is yellowish brown and dark
yellowish brown silt loam. The substratum from 36 to 60 inches is mottled
yellowish brown cherty loam or very cherty loam and from 60 to 72 inches
is mottled red clay. Slopes range from 0 to 7 percent.

DATE: November 29, 1983
At the Board of Supervisors' meeting on November 9, 1983, the
Frederick County Board of Supervisors referred -the conditional use
permit request by Ralph W. Poe back to the Planning Commission for
further_ consideration. The discussion at the Board of Supervisors
meeting revolved around two general areas. The first area of
discussion was precisely the types of vehicles that Mr. Poe proposed
to have for sale on his property. Subsequent to that meeting, the
staff met with Mr. Poe and Mr. Poe has stated that his intentions as
to the sale of vehicles are as shown below.

NOT FOR SALE ON THE PROPERTY:

It is the belief of the staff that the Board of Supervisors would
appreciate a recommendation from the Planning Commission which
specifically outlines the types of vehicles that are approved for
sale and those that are not approved for sale.

The second area of discussion at the Board of Supervisors' meeting
revolved around the existing conditions on the site. There was
considerable discussion as to whether those conditions were being met
at this time. The staff noted that during annual reviews and through
inquiries at the office, it had not been made aware in any way that
there were violations taking place of conditions on the site. Mr.
Ambrogi, the Commonwealth's Attorney, will be at the meeting on
December 7 to brief the Planning Commission on his determination as
to the ability of the Planning Commission or Board of Supervisors to
change or add additional conditions onto the existing campground
conditional use permit. The staff does not believe that the Board of
Supervisors is requesting any direct action on this particular area
of discussion. The Board, however, did feel that the Planning
Commission needed to be made aware of comments made at the Board
meeting concerning the compliance with existing conditions.
All adjoining property owners have been renotified. The Planning
Commission should take action on the first area of concern of the
Board of Supervisors and if it feels it is necessary, should amend
its recommendation to directly state the types of vehicles that would
be for sale on the property under the conditional use permit.

The Commission amended their previous recommendations of November 2,
1983 and these conditions should be listed on the permit below the
campground conditions:
II. VEHICLE SALES CONDITIONS
1. Vehicles for sale on the property shall include only motor homes,
travel trailers, pop-up trailers, and van conversions (mini -motor
homes).
2. The total number of vehicles for sale on the property is limited
to six ( 6 ) at any one time.
3. This section of Conditional Use Permit #021-79 entitled,
II. VEHICLE SALES CONDITIONS, is subject to annual review and
renewal by the staff, Planning Commission, and the Board" of
Supervisors.
Upon consultation with the Commonwealth Attorney, the Commission
determined that the Planning Commission or the Board of Supervisors
does not have the ability to change or alter any existing conditions
on the campground. If the Board believes that additional conditions
are necessary to address vehicle sales, those conditions should be
listed under II. VEHICLE SALES CONDITIONS.

This letter will acknowledge our conference of approximately
three (3) weeks ago in reference to another application for
a conditional use permit by Ralph W; Poe, in reference to the
Candy Hi11'Campgroun d. As your records will reflect, a con-
ditional use permit was granted by the Frederick County Board
of Supervisors to Ralph W. Poe to operate a family campground
on his acreage at the end of Ward Avenue in Back Creek Magis-
terial District of Frederick County, Virginia, About eighteen
(18) months later, the Honorable Robert K. Woltz, Judge of
the Frederick County Circuit Court, adjudicated that the action
of the Frederick County Board of Supervisors in issuing the
conditional use permit was null and void, in that the tbchni-
cality of holding a public hearing and the advertising
ancillary thereto had been overlooked or disregarded by the
Frederick County Planning Commission and the Frederick County
Board of Supervisors.
I enclose herewith another application for a conditional use
permit on behalf of Ralph W. Poe. In this application, he
requests a conditional use permit to operate a campground
on his real estate at the end of Ward Avenue in Back Creek
Magisterial District as'described in the application.
I am having this application and attachments hand -delivered
in orddr that the same may be expedited. I specifically
request that the publi6 hearing or hearings before the
Frederick County Planning Commission and the Frederick County
Board of Supervisors beheld as promptly as possible,.keeping

Dear Mr. Riley:
I have received your letter of September 13, 1979, and its
enclosures.
I did provide a Site Plan with my application for conditional
use permit on behalf of Ralph W. Poe; however, I understand
from the third paragraph of your letter that you wash us to
particularly address section 21-146 (d)(e)(g)(i)(l) of the
Circuit County Code on zoning on our Site Plan. Please be
advised that I am referring this. matter to Mr. Poe, and/or
has surveyor on this date. I am sure that we will comply with
your request by filing a new Site Plan or by =upending the
present Site Plan.
I note that the hearing before the'Frederick County Planning
Commission is scheduled for November 7, 1979. It is my un-
derstanding that the hearing before the Frederick County
Board of Supervisors will follow soon therefter. In view
of the past difficulties with this matter,.I am sure that
I can depend upon you to see to it that proper notice and
publication of the public hearing before.both the Frederick
County Planning Commission and the Frederick County Board
of Supervisors is given.
