Hello Kamal. In response to your two inquires:
1. A condition was placed on each approved CUP application stating that "In the
event a telecommunications tower is not erected within twelve (12) months of the
approval of this Conditional Use Permit, then the CUP will be deemed invalid."
Therefore, if you anticipate a failure to comply with this condition, it may be
appropriate for you to re -apply for a CUP and have the condition modified, and the
time frame extended.
2. The Hunting Ridge tower CUP approval enabled the construction of a 195 foot
telecommunication tower. Therefore, you'll need to keep the tower under 195-feet
tall.

this is different from the original plan but only by a small degree (1 foot) and I
wanted to get your input on whether this would be acceptable. The other alternative
is to build the tower shorter by four foot, which is also OK by me, but could give
reason for a uncooperative future carrier to demand a new tower.

Dear Mr. Doshi:
This letter is to confirm action taken by the Frederick County Board of Supervisors at their meeting on
March 13, 2002. Your request for a revision to Conditional Use Permit #18-01 for a 260-foot-high lattice -
type telecommunications facility, rather than the 195-foot-high lattice -type tower which was approved on
January 23, 2002, was approved. The approval also granted a reduction in the setback requirements against
the property lines. The application was approved with the following conditions:
All Zoning Ordinance requirements and review agency comments shall be addressed and complied
with at all times.
2. The tower shall be available for co -locating personal wireless services providers.
A minor site plan shall be approved by the County. —
4. The tower shall be removed by the applicant or property owner within twelve (12) months of
abandonment of operation.
5. In the event a telecommunications tower is not erected within twelve (12) months of the approval
of this Conditional Use Permit, then the CUP will be deeded invalid.

Dear Mr. Doshi:
It was very nice meeting you the other night at our Frederick County Planning Commission
meeting, I did -truly appreciate yourgentle-manly approach.to my questions. regarding the Revised
Conditional. Use Permit #18-01 Cross Junction Tower. As I indicated to you, I am a new member
of the FCPC and had not been involved in the initial proceedings regarding your request to place a
lattice -type .telecommunications facility on -property ID Number 18 A-18. I did, however, go out
to the si�e on Tuesday morning in preparation for Wednesday night'smeeting, and had an
opportunity to meet two members of Mrs. Collins' family. As you know, she is the property
owner adjacent to the land on which you are proposing to erect your tower. They are rural
residents of Frederick County, and they expressed very deep concerns regarding this proposed
tower, mostly in.reference -to "quality of W'.issues.
Without having_a_map, I could not -determine what was meant by my Review notes, `The applicant
has attempted to place the facility in the middle of the site (property under common ownership),
maximizing the structural setback."It appears to me to be. very close to Mrs. Collins property, the
road, and a small village. Would you -please clarify this -point for me?
I am a lifelong -resident. of the Winchester/Frederick County area, residing in my present home for
forty years. When my husband and I built our home, it was "out in the country." I enjoyed the -
sounds of nature such as birds, crickets, and frogs. Now, the tractor trailer -sounds of 81 roar
through my backyard. Many of the-surrounding_wetlands have been filled in, so I don't hear the
frogs anymore._ As a result of all this manmade noise, I could have withdrawn from this turmoil
into the peace and silence of my home. However, I chose .to adapt to my natural environment by
placing stone shaped, speakers into my flower -gardens allowing tranquil.music to float upon the
breeze.. This does not drowned out the truck noise completely, but I'm working on it! This past
summer, I had�small pond installed at the back of my yard, and then in the fall friends stocked it
with nine frogs. With great.delight, I'm anticipating -that I will hear the "Spring -Peepers" this year.
The purpose of the above information is .to ask one simple, question. As you -pursue your. quest to
instalLa. communication tower in what is now a very rural area of Frederick County, are you
willing to work with the local residents of that small community, such as Mrs. Collins, on " quality
of life issues"? This could be something as simple as adding additional landscaping such as
planting lots of trees to screen the view of the base of your tower from Mrs. Collins' deck. I am
well aware of the fact that the residents of The Summit want this tower, but it is not in their
backyard. I am well aware the battle cry of growth, but every person needs to have a game plan,
to keep a positive attitude, and to practices the art of conversation, which includes listening. This
will results in the whole team winning the game.
On a personal note, as an environmentalist, has the field of Telecommunications addressed the
issue of towers being in the pathway of migratory birds? This has been a serious problem facing
our nation as thousands of these birds have been killed over the last decadeas more _and more of
these towers have been erected. Has there been a device invented which can be added to these
towers as a warning signal to these transitory birds, and if so, will your tower have such an
apparatus? If you have any information on this topic, I wish you would please share it with me.
I have taken the liberty of including a copy of my poem, I Don't Hear the Frogs A more_ I wrote
this poem as part of an Earth Day celebration in the spring of `95, but the message is still clear
today which is asking all of us to be good stewards of God's creation.

LOCATION: This property is located at the corner of Collinsville Road and Cross Junction
Road, approximately 290 feet from North Frederick Pike (Rt. 522N).
MAGISTERIAL DISTRICT: Gainesboro

REVIEW EVALUATIONS:
Virginia Dept. of Transportation: The application for a conditional use permit for this property
appears to have little measurable impact on Rt. 770, the VDOT facility which would provide access
to the property. Existing entrance is adequate for proposed use. However, should use ever expand
in the future, the entrance may have to be upgraded to VDOT minimum standards.
Fire Marshal: Maintenance of roadway for emergency vehicle access. 14.5 foot vertical clearance
and entire width per NFPA. Roadway requirements allow for enhancement of Rural Fire Protection
in Wildland Fire Control. Plan approval is recommended.

Inspections Department: Structures shall comply with The Virginia Uniform Statewide Building
Code and Section 312, Use Group U (Utility) of The BOCA National Building Code/1996. Please
note Chapter 17 of BOCA for special inspection requirements for this type structure (concrete/bolt
testing, etc.)
Public Works/Engineering: Disturbance of more than 10,000 s.f. will require an erosion and
sediment control plan and a land disturbance permit. This land disturbance include access roads and
site development.
Winchester Regional Airport: Please see attached letter from Serena R. Manuel, Executive
Director, dated 01122102.
Planning and Zoning: The Frederick County Zoning Ordinance allows for Commercial
Telecommunication Facilities in the RA (Rural Areas) Zoning District with an approved Conditional
Use Permit. The Frederick County Zoning Ordinance specifies that a CUP for a commercial
telecommunication tower may be permitted provided that residential properties, land use patterns,
scenic areas and properties of significant historic values are not negatively impacted. Furthermore,
additional performance standards shall apply to the CUP review in order to promote orderly
economic development and mitigate the negative impacts to adjoining properties.
The Board of Supervisors granted the initial request for CUP#18-01 on January 23, 2002. This
approval enabled the construction of a 195-foot-high lattice -type telecommunications tower. The
approval also granted a reduction in the setback requirements against the property's northeast and
southeast property lines. The application was approved with the following conditions:
1. All Zoning Ordinance requirements and review agency comments shall be addressed
and complied with at all times.
2. The tower shall be available for co -locating personal wireless services providers.
3. A minor site plan shall be approved by the County.
4. The tower shall be removed by the applicant or property owner within twelve (12)
months of abandonment of operation.
5. In the event a telecommunications tower is not erected within twelve (12) months of
the approval of this Conditional Use Permit, then the CUP will be deeded invalid.

Following discussions with the Planning Commission, the Board of Supervisors, and representatives
from SunCom/Triton PCS, the applicant determined that an increase in tower height to 260 feet
would better accommodate the needs of the community and personal wireless service providers.
Therefore, the applicant has requested the ability to increase the tower's height by 65 feet, bringing
the tower height to 260 feet. The applicant contends that the increased tower height will enable
personal wireless carriers to provide a more efficient service to the community as topographical
restrictions will be lessened.
The applicant is requesting a reduction of the setbacks pursuant to Section 165-48.6(B).1 of the
Zoning Ordinance as the proposed increase in height would require an increase in structural setback
distances. Based on the proposed 260-foot height, the setbacks would be as follows:

The Planning Commission may reduce the required setback distance for commercial
telecommunication facilities if it can be demonstrated that the location is of equal or lesser impact.
The applicant has attempted to place the facility in the middle of the site (property under common
ownership), maximizing the structural setback. The applicant has provided a letter (dated January
2, 2002) certified by the Tower Manufacturers Professional Engineer indicating that the tower can
be built with a safety stress point to reduce its fall zone.
The applicant is also requesting the ability to continue to utilize lattice -type material construction
pursuant to Section 165-48.6(B)2 of the Zoning Ordinance. The Zoning Ordinance requires that new
commercial telecommunication facilities be of monopole -type construction. The Planning Commission
may allow lattice -type construction for new commercial telecommunication facilities that are located

outside of the Urban Development Area, and are not adjacent to properties that are identified as
historic areas. The proposed site is located outside of the UDA,-and is not in close proximity to any
identified historic areas. Therefore, allowing a lattice -type tower would be in conformance with the
intent of the Zoning Ordinance. This proposed commercial telecommunication facility will be in
conformance with Section 704 of the Telecommunication Act of 1996. In evaluating this application,
it has been demonstrated that there is a need for the infrastructure within the area of the County
identified.
STAFF CONCLUSIONS FOR THE 2-20-02 PLANNING COMMISSION MEETING:
Staff believes that this application for a Commercial Telecommunication Facility has adequately
addressed the requirements of the Zoning Ordinance in that need for this facility, based on a lack of
coverage and capacity in this part of the County, has been demonstrated. Further, a reduction of the
setback requirements, as well as allowance for a lattice -type tower construction, may be appropriate.
Should the Planning Commission choose to recommend approval of this application, the following
conditions of approval would be appropriate:
All Zoning Ordinance requirements and review agency comments shall be addressed and
complied with at all times.
2. The tower shall be available for co -locating personal wireless services providers.
A minor site plan shall be approved by the County.
4. The tower shall be removed by the applicant or property owner within twelve (12) months
of abandonment of operation.
5. In the event a telecommunications tower is not erected within twelve (12) months of the
approval of this Conditional Use Permit, then the CUP will be deemed invalid.
PLANNING COMMISSION SUMMARY & ACTION OF 02/20/02 MEETING:
Numerous issues were discussed by the Planning Commission. Commissioners asked if SunCom/
Triton PCS had indicated for certain that the additional tower height would now meet their service
requirements for this area. They verified with the applicant that the setback requirements regarding
the easements would be legally recorded through a lease agreement between Shared Towers and the
property owner. Commissioners verified with legal counsel that the County would not be held liable
for damages, if the tower collapsed. They discussed the contents of a letter submitted by the
applicant's engineer certifying that tower construction will include safety stress points to reduce the
fall zone to within the property owners' boundaries and they heard the applicant's explanation of

specifications regarding the wind load design. Commission members also discussed the need to
specify the exact height of the tower, plus the additional height required for the lightening rod.
The applicant spoke with the Commission about why this particular location was selected for tower
placement and his primary objectives for service coverage; he spoke of the pros and cons of using
lattice structures versus monopoles; he discussed his meetings with SunCom/Triton PCS and county
officials; and the Summit community's desire for service coverage.
One adjoining property owner came forward and had questions regarding the distance of the tower
to her property line, concerns about the possibility of the tower collapsing, and the affect on the
viewshed from her home and for the Cross Junction community as a whole.
Overall, the Planning Commission was satisfied that their concerns had been adequately addressed.
They believed that the increased height of the tower was appropriate in light of the increased service
area capability and usability by other service providers. The Commission recommended approval of
the Cross Junction Tower CUP #18-01 for a 260-foot lattice telecommunications tower, with a six-
foot lightening road placed at the top, with the requested setback waivers, and the following
conditions:
1. All Zoning Ordinance requirements and review agency comments shall be addressed and
complied with at all times.
2. The tower shall be available for co -locating personal wireless services providers.
3. A minor site plan shall be approved by the County.
4. The tower shall be removed by the applicant or property owner within twelve (12) months
of abandonment of operation.
5. In the event a telecommunications tower is not erected within twelve (12) months of the
approval of this Conditional Use Permit, then the CUP will be deemed invalid.

Dear Sir:
The Winchester Regional Airport Authority offers the following comments on the above
referenced revised site plans as conditions to be included for approval of this site ptan:
1. As required by FAA regulations, structure must be,marked and lighted in
accordance with FAA Advisory Circular 70/7460-1 J, Obstruction Marking and
lighting, Chapters 4, 8 (M-Dual) & 13
2. Consideration should be given to the owner/operator of the Timber Ridge
Airport which is a private airport located approximately four nautical miles
from two of the towers as to possible impact on that facility.
These comments are based on review provided by our engineering firm, Delta Airport
Consultants, Richmond, Virginia. They have determined that the proposed revision in
the height of the tower does penetrate any FAR Part 77 surfaces therefore there should
be no impact on current or future operations at the Winchester Regional Airport.
Final comment will be withheld pending review of the FAA's determination of the
aeronautical study. If the above referenced conditions along with any others outlined in
the FAA's study are met, the Winchester Regional Airport Authority has no objections to
this conditional use permit.

We are requesting an amendment to an original Conditional Use Permit that was approved on January 23,
2002 for the Cross Junction Communications Tower. The approved height of this tower is 195 feet. We
are requesting an increase in height to 260 feet to improve cellular coverage provided by this tower.
Winchester Regional Airport has provided its comments on this height increase. All other Agencies
comments remain unaffected, as the nature of their concerns would not be affected by this height increase.
We have also obtained and attached a letter certified by the Tower Manufacturers Professional Engineer
indicating that the tower can be built with a safety stress point to reduce its fall zone. The attached sketch
indicates that the height increase will require additional setback waivers. We request your approval of the
height increase through the Frederick County Planning Commission and the Frederick County Board of
Supervisors as the proposed structure will not affect the safety of the adjoining neighbors as we commit to
designing stress points for the tower to fall within the landlord's properties.
The original application is attached with height related matters updated.

The referenced tower will be designed to meet the specified loading requirements in accordance with
ANSI/TIA/EIA-222-F Standards for a 70 MPH basic wind speed, no ice. The 70 MPH basic wind speed is assumed
constant up to 33' above ground level and is escalated to an effective wind speed of approximately 98 MPH at the
top of the tower.
In the event an extreme wind speed were to occur, failure would not be expected to occur the instant the design wind
speed was exceeded. All tower members will be designed to support a minimum of 1.25 times their design load
without permanent deformation. This would be equivalent to an effective wind speed of 82 MPH at the base of the
tower and escalate to 110 MPH at the top of the tower.
Based on customer specifications, the tower may be designed with heavier members than required by analysis in the
lower portion of the structure. Therefore, in the unlikely case of failure, the point at which such failure would occur
would be in the upper portion of the tower, allowing the upper portion to fold over the lower portion, limiting the
area affected by the failure.

The Winchester Regional Airport Authority offers the following comments on the above
referenced site plans as conditions to be included for approval of this site plan:
1. Although not required by FAA, structure should be marked and lighted in
accordance with FAA Advisory Circular 70/7460-1 J, Obstruction Marking and
lighting, Chapters 4, 8 (M-Dual) & 13
2. Consideration should be given to the owner/operator of the Timber Ridge
Airport which is a private airport located approximately four nautical miles
from two of the towers as to possible impact on that facility.
These comments are based on the review provided by our engineering firm, Delta
Airport Consultants, Richmond, Virginia. They have determined that these. proposed
towers do not penetrate any FAR Part 77 surfaces therefore there should be no impact
on current or future operations at the Winchester Regional Airport.
If the above referenced conditions along with any outlined in the FAA study are met, the
Winchester Regional Airport Authority has no objections to these site plans.

I have enclosed a map showing locations of cell towers in the county. You will recall that we had agreed to
provide such a map per discussion with Mr. Harrington Smith at January 23`d meeting of the Board of Supervisors.
Greenway Engineering has submitted on January 25th:
• An amendment to the application for Cross Junction tower to raise it to 260' to allow placement of
Shentel and other carriers at very good heights of 260', 250', 240', 230' respectively.
A new application to move Hunting Ridge tower approximately 1100' South. This moves the tower closer
to Route 522 and at a meeting hosted by planning department SunCom/Triton had agreed that this
location would work better for them. Shentel has agreed to go on this tower at either location. As this
move allows the tower to be away from the landowners' driveway, they have agreed to allow lattice
structure, so we are requesting permission for that change also. Upon approval, we will withdraw the
approved CUP for the original location.
I understand that these will be heard by the Planning Commission and later submitted to the Board of Supervisors
for action.

Cross Junction Communication Tower - Update
We have made considerable progress towards raising the height of the Cross Junction tower per our earlier
discussion for improved coverage.
• Airport We have requested Winchester Regional Airport for their comments on increasing the
height. Their comments are required by the Planning Department for the Conditional Use Permit
(CUP) amendment process. Our consultants provided analysis indicating that new height will not
affect the airport. The airport will be providing their comments as soon as they obtain
confirmation from their independent consultants.
• Historical Preservation We have performed study of a larger area for historical structures and
submitted it to State Historical Preservation Officer for their review. We hope to receive their
approval as no preservation eligible properties were affected. This approval is necessary for
construction but not required by the Planning Department CUP process.
• Setbacks Greenway Engineering has prepared a new exhibit showing the tower location and the
needed setback waivers with the increased height. We have also received a letter from the tower
manufacturer signed by a licensed professional engineer indicating that they can design the
structure to have deliberate stress point so that the tower would fall within the property and the
waivers will not affect safety of neighbors.
• Plannine The Deputy Director of Planning, Mr. Lawrence, advised us that the increase in height
would require a hearing with the Planning Commission before it could be considered by the Board
of Supervisors.
Accordingly, we request approval of the tower at the currently proposed height. We are committed to
designing the structure for a height increase to 250'. We will bring the CUP amendment request for the
height increase as soon as we can process it through the Planning Department and Planning Commission.
We have also attached a letter from Shentel indicating their interest in the towers at the currently proposed
heights.

Fire Marshal: Maintenance of roadway for emergency vehicle access. 14.5 foot vertical clearance
and entire width per NFPA. Roadway requirements allow for enhancement of Rural Fire Protection
in Wildland Fire Control. Plan approval is recommended.

Public Works/Engineering: Disturbance of more than 10,000 s.f. will require an erosion and
sediment control plan and a land disturbance permit. This land disturbance include access roads and
site development.
Winchester Regional Airport: Please see attached letter from Serena R. Manuel, Executive
Director, dated 10122101.
Planning and Zoning: The Frederick County Zoning Ordinance allows for Commercial
Telecommunication Facilities in the RA (Rural Areas) Zoning District with an approved Conditional
Use Permit. The Frederick County Zoning Ordinance specifies that a CUP for a commercial
telecommunication tower may be permitted provided that residential properties, land use patterns,
scenic areas and properties of significant historic values are not negatively impacted. Furthermore,
additional performance standards shall apply to the CUP review in order to promote orderly
economic development and mitigate the negative impacts to adjoining properties.
The applicant proposes to build a 195-foot lattice -type telecommunication facility that is designed to
accommodate commercial telecommunication carriers. The proposed facility will be located on a
96.41-acre site located east of Route 522. The applicant has provided an inventory of existing
telecommunication facilities in the area, and staff would concur that there are no existing facilities or
appropriate structures available for collocation in this general area. The maps provided within the
application analyzing coverage need in this area appear to be sufficient to determine the adequacy of
the search area, and the existing coverage and capacity of the licensee holder in the vicinity of the
proposed facility. As shown on the maps, the coverage needs will be met by a facility in this location.
The applicant will be required to provide lighting to comply with the requirements of the Winchester
Regional Airport Authority. The lights shall comply to FAA standards as noted in the letter submitted
by the Director of the Airport Authority. The Frederick County Zoning Ordinance requires that these
lights be shielded from ground view to mitigate illumination to neighboring properties and right-of-
ways. Buffer and screening requirements will be determined at site plan review.
The applicant is requesting a reduction of the setbacks pursuant to Section 165-48.6(B).1 of the
Zoning Ordinance as they are proposing to locate the commercial telecommunication facility
approximately 35 feet from property line boundaries. The Zoning Ordinance provisions require that
towers of 195 feet or higher (as is proposed) be placed a minimum of 220 feet from road right-of-
ways and 210 feet from side property lines. The Planning Commission may reduce the required
setback distance for commercial telecommunication facilities if it can be demonstrated that the
location is of equal or lesser impact. The applicant has attempted to place the facility in the middle
of the site maximizing the structural setback. The request for a reduced setback of 35 feet from the
property line has been made in order to provide increased flexibility in the exact location for the
placement of this tower.

The applicant is requesting the ability to utilize lattice -type material construction pursuant to Section
165-48.6(B)2 of the Zoning Ordinance. The Zoning Ordinance requires that new commercial
telecommunication facilities be of monopole -type construction. The Planning Commission may allow
lattice -type construction for new commercial telecommunication that are located outside ofthe Urban
Development Area, and are not adjacent to properties that are identified as historic areas. The
proposed site is located outside of the UDA, and is not in close proximity to any identified historic
areas. Therefore, allowing a lattice -type tower would be in conformance with the intent of the Zoning
Ordinance. This proposed commercial telecommunication facility will be in conformance with Section
704 of the Telecommunication Act of 1996. In evaluating this application, it has been demonstrated
that there is a need for the infrastructure within the area of the County identified.
STAFF CONCLUSIONS FOR THE 12-05-01 PLANNING COMMISSION MEETING:
Staff noted that the applicant has stated by letter, dated November 15, 2001, that this tower will have
space available free of charge for Frederick County emergency communications. Staff believes that
this application for a commercial telecommunication facility has adequately addressed the
requirements of the Zoning Ordinance in that need for this facility, based on a lack of coverage and
capacity in this part of the County, has been demonstrated. Further, a reduction of the setback
requirements, as well as allowance for a lattice -type tower construction, may be appropriate. Should
the Planning Commission choose to recommend approval of this application, the following conditions
of approval would be appropriate:
All Zoning Ordinance requirements and review agency comments shall be addressed and
complied with at all times.
2. The tower shall be available for co -locating personal wireless services providers.
3. A minor site plan shall be approved by the County.
4. The tower shall be removed by the applicant or property owner within twelve (12) months
of abandonment of operation.
PLANNING COMMISSION SUMMARY & ACTION OF 12/05/01:
An attorney representing Triton, PCS, a licensed service provider in Frederick County, requested that the CUP
application be denied or deferred until his client could submit their own tower applications for alternative sites.
The representative stated that studies conducted by his clients determined that serious transmission gaps would
occur along Rt. 522, if the Hunting Ridge and Cross Junction tower sites were used with Triton's system. The

representative said that his client believed a tower should not be constructed until a service provide has a need
for the tower in a specific location. A radio frequency engineer and a deployment manager were also present
to speak on behalf of Triton, PCS.
An adjoining property owner spoke in opposition to the request for a reduction of the setbacks for placement .
of the tower.
The applicant and the applicant's representative believed their business's success depended on designing towers
for multiple users and, if a tower is empty or only has one tenant, their project has failed. They believed the
data provided was good, credible data, provided by radio frequency engineers with 40+ years of experience.
The applicant stated that he had met with representatives of Triton and he believed a technical solution was
available to Triton to meet their particular needs. The applicant believed that the tower locations as proposed
were appropriately placed.
Planning Commissioners discussed whether it was more appropriate for the service provider or the tower
provider to determine the most appropriate tower locations. Some commissioners were not in favor of tower
speculators; they believed it would necessitate service providers coming in with "fill-in" tower requests. Other
commissioners were of the opinion that Triton, PCS's coverage requirements would not necessarily be
duplicated by another service provider. Further, a reduction of the setback requirements, as well as
allowance for a lattice -type tower construction, may be appropriate.
By a majority vote, the Planning Commission recommended approval of CUP # 18-01 with a reduction of the
setback requirements, as well as allowance for a lattice -type tower construction, as requested, with the
following conditions:
1. All Zoning Ordinance requirements and review agency comments shall be addressed and complied
with at all times.
2. The tower shall be available for co -locating personal wireless services providers.
3. A minor site plan shall be approved by the County.
4. The tower shall be removed by the applicant or property owner within twelve (12) months of
abandonment of operation.

2. Consideration should be given to the owner/operator of the Timber Ridge
Airport which is a private airport located approximately four nautical miles
from two of the towers as to possible impact on that facility.

Airport Consultants, Richmond, Virginia. They have determined that these proposed
towers do not penetrate any FAR Part 77 surfaces therefore there should be no impact
on current or future operations at the Winchester Regional Airport.
