VARIANCE: 16' front yard variance for a garage
REASON FOR VARIANCE: The property is relatively narrow and the
location of the proposed garage would provide the best relationship
to the existing house. Additionally, only one adjacent property
uses the deeded right-of-way which is what makes the lot a corner
lot.
STAFF COMMENTS: The 60' front setback is required for both road
frontages of a corner lot, which is primarily to provide an
adequate distance to maintain the rural character of the district.
In this case, the lot is technically a corner lot since there is a
deeded right-of-way along the side of the lot, but the right-of-way
is not used as a typical street. As the applicant has stated, the
right-of-way serves only one adjacent lot and is more like a
driveway than a street. Further, the road pattern and size of
adjoining parcels makes it very unlikely that the right-of-way
would ever need to serve more than the one parcel to the rear of
applicant's lot.
Although this case does not meet the strict application of the
"undue hardship" requirement, there is a reasonable basis for
granting this variance.

VARIANCE #
I (we), the undersigned, do hereby respectfully make
application and petition the Frederick County Board of Zoning
Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick Co. officials
to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed at the front property line at least
seven (7) days prior to the BZA public hearing and maintained so
as to be visible from the road or right -of -way -until the hearing.
