Dear Mr. and Ms. Bennett:
On October 16, 2003 staff from our department met with Mr. Bennett to discuss the shed located on the front
side (adjacent to Kingsland Court) of lot 121 in Pembridge Heights. The original front setback for this lot
in Pembridge Heights Subdivision is 25'. On March 15, 1994 the Board of Zoning Appeals (BZA) approved
a 4.25' front yard setback variance for this property (application #003-93), therefore making the setback on
the "front" sideof the lot is 20.15'. Based on our measurements, the shed located on your property is located
within the required setback set forth by the BZA. It is our determination that your property is not in
violation of the front setback of this lot and therefore there are no grounds to pursue this matter further.
Any aggrieved party has the right to appeal this determination within thirty (30) days of the date of this letter
in accordance with Section 15.2-2311 of the Code of Virginia. This decision shall be final and unappealable
if it is not appealed within thirty (30) days. Should an appeal be pursued, the appeal must be filed with the
Zoning Administrator and the Board of Zoning Appeals (BZA) in accordance with Article XXI, Section 165-
155A(1), of the Frederick County Zoning Ordinance. This provision requires the submission of an
application form, a written statement setting forth the decision being appealed, the date of decision, the
grounds for the appeal, how the appellant is an aggrieved party, any other information you may want to
submit, and a $250.00 filing fee. Once the appeal application is accepted, it will be scheduled for public
hearing and decision before the BZA.

STAFF COMMENTS: This subdivision was approved with 25' front
setbacks. Since this is a corner lot and the short side of a
corner lot is considered to be the front, the requested variance is
actually on what is regarded as the front side of the lot. The
rear of the lot is actually where the left end of the house is
located and this requires a 25' setback also. This lot is only
8,378 square feet in size and is further restricted by the fact
that it is a corner lot which consumes a large part of the area.
All of these are facts that should have been known by the owner
prior to purchasing this lot. There is no hardship involved here
and permitting this intrusion would be totally out of character
with the other houses in the neighborhood. Adding to this house
would decrease the sight visibility for traffic approaching this
corner. There is currently a storage building on this property
setting in the front setback zone which will need to be moved.
STAFF RECOMMENDATIONS: Denial. There is no proven hardship and
permitting this variance would be out of character with the
neighborhood.

Grantor, and Charles A. BENNETT, JR, and Angela L. BENNETT, husband
