The original front setback for this lot in Pembridge Heights Subdivision is 25'. On March 15, 1994 the Board of Zoning Appeals (BZA) approved a 4.25' front yard setback variance for this property (application #003-93), therefore making the setback on the "front" sideof the lot is 20.15'. Based on our measurements, the shed located on your property is located within the required setback set forth by the BZA. It is our determination that your property is not in violation of the front setback of this lot and therefore there are no grounds to pursue this matter further. Any aggrieved party has the right to appeal this determination within thirty (30) days of the date of this letter in accordance with Section 15.2-2311 of the Code of Virginia. This decision shall be final and unappealable if it is not appealed within thirty (30) days. There is no hardship involved here and permitting this intrusion would be totally out of character with the other houses in the neighborhood. Adding to this house would decrease the sight visibility for traffic approaching this corner.
