Dear Mr. Stotler:
This letter is to confirm action taken by the Frederick County Board of Zoning Appeals at
their meeting of February 16, 1993.
Your application #001-93 was approved for the following variances:
a 1.324 acre variance from the 2 acre minimum lot size, a 127.8 foot variance from
the 250 foot frontage requirement for a 2.3 acre lot, a 62.3 foot variance from the
250 foot frontage requirement for a .676 acre lot and a 125.6 foot variance from the
allowable depth of 489 feet. Also, a 1.8 foot side yard variance for an existing house
and a 9.2 foot .side yard variance for an existing storage building.
This property is located sixteen miles northwest of Winchester on State Route 127, in the
Gainesboro District, and is identified as GPIN 11000OA000012A and 110000A000011.
As per the condition placed on the approval, we are in receipt of the notarized affidavit
attesting to the legal nonconforming status of the various structures on the two properties
which do not meet current setback requirements.

setback requirements. These buildings were constructed many years
ago for the sole purpose of providing shelter for firewood and
various assortments of lawn and garden tools. When constructed
there were no known zoning requirements.

REASON FOR VARIANCE: These variances are required as a result of
a boundary line adjustment which corrects the problem of having two
dwellings on a property. Other existing conditions were not known
to be in violation of the setback requirements until the boundary
line adjustment was brought to the planning staff for consultation.
This will enable applicant's parents' dwelling to be separated from
applicant's lot and combined with a small adjoining lot. This
boundary adjustment will allow for the legal disposition of either
property, should that ever be necessary.
STAFF COMMENTS: The lot size, frontage, depth, and setback
requirements in the Rural Areas district are primarily to provide
for proper separation of dwellings and efficient use of land, while
maintaining the rural character of the district.
The existing conditions on this property make this a somewhat
complicated case. Presently, there are two lots along Route 127,
one of which is 2.6 acres, and one which is .3 acres (see plat for
an illustration of this). The applicant built a second dwelling on
the larger parcel, where his parents' dwelling already existed, not
realizing this was a violation of the zoning ordinance. A building
permit was issued for the dwelling, but it is not clear whether the
permit was issued with an understanding that there was already a
dwelling on the property. This boundary line adjustment would
correct that problem, but would necessitate several of these
variances. It should be noted, however, that the existing
conditions were already short of the ordinance requirements in
terms of frontage and lot size.
Applicant states that the setback problems of the existing house
and of the existing storage building behind the house (on the east
side of the larger parcel) resulted from ignorance of the setback
requirements. That does not give sufficient reason for granting a
variance for the setback violations. However, in view of the
slight nature of the setback violation for the house and the close -
together character of the structures in the immediate area, some
leniency may be appropriate. The applicant will need to provide
more sufficient explanation of the need for a variance for the
storage building.
STAFF RECOMMENDATIONS: Approval of all requests except for the
9.2' setback variance for the storage building, based on lack of
support as to its need. In addition, the variance should be based
on the following condition:
1. That the applicant provide an affidavit attesting to the
legal nonconforming status of the various structures on the
two properties which do not meet current setback requirements.
