REASON FOR VARIANCE: The applicant is seeking a variance due to "the shape and location of the property in relation to the adjacent existing businesses and the nearby interstate intersection as well as the topographic conditions of the site in relation to the interstate. STAFF COMMENTS: According to the Code of Frederick County, signs located within a B-2 zoning district are restricted to 35 feet in height. The applicant wishes to place a sign that is 60 feet in height. The applicant seeks this variance so that the sign can be visible from Interstate 81. We do not argue that visibility is important to the success of a business, but to what extent do we measure visibility so important that it pollutes the viewshed of our visitors and residents who live nearby? Success is also an arbitrary term which a variance cannot address. Variances are granted only when the strict interpretation of the ordinance imposes an undue hardship upon the applicant. The height restriction does not prohibit the intended use of the land. In addition, gain or loss of monetary value is not a criteria for granting a variance. A sign reaching the height of 35 feet is clearly visible from adjacent roads and Interstate 81. A customer would have no problem identifying the location of the business. The sign for McDonald's, which is 35 feet in height, is clearly visible from Interstate 81. In addition, "visibility" can also be accomplished through the use of interstate logo signs that give direction as well as distance.
