REASON FOR VARIANCE: The applicant is seeking a variance due to the shape and the location of the property in relation to the adjacent existing businesses and the nearby interstate intersection as well the topographic conditions of the site in relation to the interstate. STAFF COMMENTS: Chapter 165, Section 30(H) states that no business sign or directional sign shall exceed one hundred square feet in area. The Code already makes allowances for franchise signs, stating that they "may exceed 100 square feet in area but shall not exceed one hundred and fifty square feet in area." The applicant wishes to exceed this limit by 82 square feet. Staff feels that 150 square feet offers more than adequate visibility, especially when posted at the proper height of 35 feet. The size requirement does not create an undue hardship. Section 15.1-495 of the Code of Virginia, which specifies the powers and duties of the board of zoning appeals, states that variances may be granted when: i "the strict application of the terms of the ordinance would effectively prohibit or unreasonably restrict the utilization of the property or where the board is satisfied upon the evidence heard by it, that the granting of such variance will alleviate a clearly demonstrable hardship approaching confiscation, as distinguished from a special privilege or convenience sought by the applicant."
