Signs identify the property as Weber's Nursery. MAGISTERIAL DISTRICT: Stonewall PROPERTY ID NUMBER: 54-A-47 & 54-A-48 PROPERTY ZONING & USE: Zoned B2 (Business General); land use - nursery, greenhouse, and garden center ADJOINING PROPERTY ZONING & USE: Zoning - RP (Residential Performance), M1 (Light Industrial), and B2 (Business General); Land Use - residential, vacant, greenhouse, and garden center. VARIANCE: A 35' set back variance on north and west side. REASON FOR VARIANCE: The applicant is requesting a variance "to best utilize property." The applicant states that a variance is necessary due to the "flat, non rocky area that has been a dump." "Greenhouse will fit conforming use of property, will look better, and increase county tax revenue." STAFF COMMENTS: In this case, the applicant is requesting a 35 foot variance to allow the construction of additional greenhouses. The property is zoned B-2, General Business. The proposed greenhouses would border the southwest property line and would be placed adjacent to land zoned RP, Residential Performance. According to the Code of Frederick County, developments occurring on B-2 property that is adjacent to a RP Zoning District must maintain a minimum of 50 feet with full screening. So far, the applicant has not shown that he cannot meet this requirement. Variances are sought when strict application of the ordinance imposes a specific or unusual hardship or makes the intended use of the land impossible. It is the responsibility of the applicant to • show evidence that a hardship exists. This is expressed in the By - Laws of the Board of Zoning Appeals. "The burden of proof of undue hardship rests upon the applicant, and without such proof a variance must be denied." The issues of buffers and screening can most adequately be addressed in a proper site plan review. It can then be determined whether topography, drainage, and other construction issues warrant a variance. The department of Planning and Development is available to address these issues with the applicant and to make sure every alternative has been examined. The importance of maintaining the required buffer and screening requirements cannot be over emphasized. To relax these requirements would jeopardize the value and intent of adjoining properties and their future land use. STAFF RECOMMENDATIONS: Staff recommends denial.
