VARIANCE: A 23' side yard variance for a proposed house
REASON FOR VARIANCE: The lot is small, the septic system is
already installed, and the lay of the land will not permit locating
the house so as to have adequate setback on the right side of the
property.
STAFF COMMENTS: The dimensions of the proposed house is 51'x 56'
or 2,856 square feet. Within this parcel, there is ample space to.
build within the setback requirements. In this case, the required
setbacks are 601in the front, and 50' on the sides and rear. This
leaves 11,200 square feet of buildable area. The lay of the land
would permit the construction of the proposed home within the
building footprint. The location of the septic system is not an
issue and should not be the deciding factor for the placement of
the home.
STAFF RECOMMENDATIONS: Since there is no hardship placed on the
applicant, the staff recommends denial of a variance.

application, and petition the Frederick County Board of Zoning
Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick County
officials to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application

Ridings (a/k/a Elizabeth A. Ridings), his

deed from Arthur M. Martin, et al, dated
October 25, 1974 and recorded in the Office
of the Clerk of the Circuit Uourt of
Frederick County, Virginia, in Deed Book 437
at Page 92, the said Betty A. Ridings having
since died, thereby vesting all of her right,
title and interest in this property in Dennis
L. Ridings.
Reference is here made to the aforesaid instruments and
the attachments and the references therein contained for a
further and more particular description of the property hereby
conveyed.
This conveyance is made subject to all duly recorded
and enforceable restrictions, easements and rights of way.
James H. Johnson, Jr., Sole Acting Trustee, and
Piedmont Trust Bank and Dime Savings Bank, as the secured parties
and present noteholders under that certain deed of trust dated
April 7, 1976, recorded in the aforesaid Clerk's Office in Deed
Book 472 at Page 7 and corrected in Deed Book 473 at Page 508,
and Douglas C. Arthur, Sole Acting Trustee, and The First
National Bank of Strasburg, as the secured party and present
noteholder under that certain deed of trust dated August 10, 1983
and recorded in the aforesaid Clerk's Office in Deed Book b63 at
