Your application, #004-94, , was approved for a 9.83' rear and a 40' front variance on the
primary structure, and a 5' rear and a 50' front variance on an accessory building. These
variances will apply to the 50' right-of-way as indicated on the plats presented to and approved
by Frederick County, dated 3/4/94. Should the recordation of the plats never occur, the
variances would be redundant.

VARIANCE: A 9.83' rear and a 40' front variance on the primary
structure, and a 5.0' rear and a 50' front variance on an accessory
building.
REASON FOR VARIANCE: Structures exist as legal non -conforming
structures. They existed in proximity to the old right-of-way and
were there long before the ordinance came into being. With the
establishment of a new right-of-way and new setbacks associated
with a division of the property, the buildings located there are in
violation of required setbacks.
STAFF COMMENTS: If the division of this land had not been desired
or attempted, this variance would not be necessary. Legal
nonconforming uses are allowed to remain by ordinance. Once the
desire to divide the land occurred, the setbacks instituted and the
right-of-way changed, then the rules of the game changed and the
variances in relationship to the new right-of-way were required.
The fact that there is a possibility that this land division may
not occur in the immediate future should have no bearing on the
requested action.

A major consideration in the review of this request must be the
location and possible impacts if this request is approved.
Considering the remote location, the unlikely feasibility that this
land would ever develop further, and the lack of any perceivable
impact on neighboring properties, leads one to a reasonable
decision of approval.

VARIANCE APPLICATION FOR TAX MAP 82-A-6
Question 11.
Primary Structure A may be legally non -conforming, although we have
no evidence to support or document this. If it is legally non-
conforming we request a variance to increase the size of the struc-
ture by more than 50% to not more than 93%.
We also request a 9.83 foot rear setback variance on Primary
Structure A and a 40 foot front set back variance on Primary
Structure A.
Accessory Building B will be refurbished and restored with electric
added and we understand that there is no variance needed for this.
On Accessory Building C we request a 50 foot front setback variance
and a 5 foor rear setback variance.
Question 12.
The property in question is a triangular lot, with it's narrow-
est corner being the part that is first entered onto from the
shared private driveway that extends from Route 622. This part
of the property has beautiful views of the valley and Round Hill.
Consequently, all of the structures over the years have been built
on this section of the land. The utility systems of well and
septic are on this part of the land, and it was our plan in pur-
chasing this property last August, to use these systems for the
cleaning up and development of the property. Without these vari-
ances those utilities would have to be abandoned which is a hard-
shiip we wish not to bear. We hope that as the board examines
all of the details of this request, the "undue hardship" of this
abandonment is seriously examined as just cause to grant these
variances,
The property is surrounded by open land. There are no homes or
cabins visible from the variance site. To the Southwest and to the
West there are property owners with structures more than 800 feet
away from the variance site, both of these are vacation cabins. To
the North over Cedar Creek there are no structures on any property
abutting this land in Shenandoah County. To the East is vacant
land, and one dwelling two properties over that is passed by to
access this property. That home owner is over 800 feet and also
not visible from the variance site.

Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick County
officials to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed at the front property line at least
