REASON FOR VARIANCE: Because of the slope of the land it was
necessary to cock the house so that entrance to garage would be
level.
STAFF COMMENTS: The rear setback requirement for this parcel is
501, which is primarily to provide for substantial separation of
dwellings to maintain the character of the Rural Areas district.
There appears to be sufficient level area in front of the house to
have met the setback requirement and still have a level entrance
for the garage. Applicant has told staff that the location of the
rear property line was misunderstood, which was the main reason for
the insufficient setback. However, there is a steep slope to the
front portion of the property and the house as located affords more
use of the level area in the front.
The house is in a fairly remote area and, given the existing
topography, there is no real likelihood of other houses being
placed near this house. Therefore, the house location is not
likely to adversely impact any other properties. While the strict

application of the "undue hardship" requirement is not met here,
there is a reasonable case for granting the variance.
