VARIANCE: 1' 8" front setback variance for an existing house
REASON FOR VARIANCE: Contractor changed original plan to
accommodate roof pitch and did not take setback line into
consideration. Construction of house is complete.
STAFF COMMENTS: Applicant had a surveyor stake the house location
prior to construction and the contractor violated the setback line
in spite of this precaution. This has certainly created a hardship
for and through no fault of the applicant. The contractor should
be held responsible in some manner but unfortunately this system
provides no way to punish him. The proposed house location on the
.building permit indicated the correct location within the setback
lines.
STAFF RECOMMENDATIONS: There being an obvious hardship and minimal
impact, staff recommends approval.

application, and petition the Frederick County Board of Zoning
Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick County
officials to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed at the front property line at least
seven (7) days prior to the BZA public hearing and maintained so as
