VARIANCE: 34' front and 43' side setback variance for the
expansion of the Parkins Mill Waste Water Treatment Plant
REASON FOR VARIANCE: Treatment plant upgrade requires new
treatment structures to be placed close to the property line on the
west, southwest, and south boundaries. The topography dictates the
location of these treatment structures.
STAFF COMMENTS: A 50 foot setback is required around an existing
structure in the zoning district where this treatment plant is
located. The front of the property, the western boundary, and the
portion bordering Parkins Mill Road (Route 644) both require a 50'
setback. The major intrusion into the setback zone will occur on
the western boundary where the access road enters the property.
This area is protected by the buffer easement and the entrance
easement and you would expect that this land could never be used
for anything else. It appears that neither of the proposed front
intrusions will have any impact on any adjoining property.
The southern boundary, where the 43' variance is requested, borders
a recorded buffer easement that is over 1700' in width. This
clearly protects this side of the facility and precludes there
being any impact on the adjoining property.on this side. This area
is in the flood plain and is therefore very limited in any possible
uses.
STAFF RECOMMENDATIONS: Since the need for this expansion is well
documented, there being no other viable alternative for expansion,
and the absence of any foreseeable impact on adjoining properties,
approval of this request is recommended.

Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions -for the variance required by the BZA.

officials to go upon the property for site inspection purposes.

of land owned by Grantor containing 0.74 Acre,

"Exhibit D", attached hereto and incorporated
herein in full by this reference.
The land and easements hereinabove described are a portion of
the land acquired by the Grantor herein by deed from Joseph A.
Orndorff, unmarried, dated November 16, 1984, and duly
recorded in the Office of the Clerk of the Circuit Court of
Frederick County, Virginia, in Deed Book 585, at Page 501.
The 30 foot drainage and effluent easement herein
conveyed grants to the Grantee the perpetual right to
construct, operate, maintain, repair and replace one or more
lines for drainage and passage of effluent from the Parkins
Mill Wastewater Treatment Plant to Abrams Creek, including the
right to go on, over and upon the said 30 foot easement for
the purpose of installing, laying, maintaining, repairing and
replacing the same as needed.
By conveying the "buffer easement" to the Grantee, the
Grantor obligates himself, his heirs and successors in title
to the land subject to said easement, to refrain from
constructing thereon any building or structure designed for
human habitation or occupancy.
Grantor shall retain the right to use his land which is
subject to the 30 foot drainage and effluent easement, the
buffer easement and the ingress/egress easement acquired
herein in any manner which shall not interfere with the use
and enjoyment of said rights by Grantee. Grantor shall at all
times have the right to cross over and upon the said easements
and to use the surface over the easements in such manner as

will neither injure nor interfere with the construction,
operation or maintenance of the drainage and effluent line or
lines, except that no building or other structure shall be
erected over said easements unless by mutual consent of the
parties or their successors. Whenever the enjoyment of its
rights hereunder requires Grantee to disturb the surface of
the ground, it shall be the obligation of Grantee to restore
the same to its condition prior to being so disturbed at
Grantee's expense.
The conveyance of PARCEL A herein is made subject to all
legally enforceable restrictive covenants and easements of
record, if any, affecting the aforesaid realty.
Grantor's land is subject to the lien of a deed of trust
dated November 16, 1984, recorded in the aforesaid Clerk's
Office in Deed Book 585, at Page 503, in which the Sole Acting
Trustee is one of the Trustees and the Beneficiary is holder
of the entire obligation secured thereunder. The Sole Acting
Trustee joins herein for the purpose of releasing the lien
thereof insofar as it relates to the land conveyed hereunder
and to consent that this conveyance shall not be construed as
a default as provided in said deed of trust, all of which is
with the authority and consent of the Beneficiary which is
attested by the Beneficiary's signature hereto. This release
and consent shall not otherwise affect the validity of the
lien created by the aforesaid deed of trust.
