LOCATION: In the Jefferson � Village Subdivision, 108 Allegheny Court MAGISTERIAL DISTRICT: Opequon PROPERTY ID NUMBER: 75K-1-44 PROPERTY ZONING & USE: Zoning - RP (Residential Performance) Land use -,Residential ADJOINING PROPERTY ZONING & USE: Zoning - RP (Residential Performance) Land use - Residential VARIANCE: 10' rear yard variance for the construction of a 10' x 15' deck REASON FOR VARIANCE: Due to the shape of the lot as well as the fact that the property is located at almost the head of a cul-de- sac and has a sewer easement on the front and side, made it difficult to position the house for more back yard. STAFF COMMENTS: When the building permit for this house was applied for, the builder, also the applicant, presented a plat showing the house location. This plat was marked showing a 37' front setback (35 required) and a 31' rear setback (25 required). The plat submitted with this application for a variance shows the house to have a 43' front setback and a 25" rear.setback. This gives some indication that the builder was not too careful when siting the house on the lot. It appears that with careful siting of the house, a deck could have been placed on the rear of this house with required setbacks being maintained. This©lot does not have an unusual shape nor does the sewer easement restrict the building footprint possibilities. Since this house was obviously designed for a deck since it has double sliding glass doors at the rear located 4 or 5 feet off the ground, you would think the 0 builder would have been more careful with the house siting. However, the fact that you cannot put a deck on a house does not constitute a hardship. one of the major concerns in considering this request should be the potential impact on adjoining properties if this were approved. Allowing this deck would create a situation almost exactly like the case of Pennington vs. Foster that this Board dealt with in 1991. The proposed deck would tower above the adjoining rear property which sets much lower than the property where the deck is proposed. The difference between these cases is that this deck has not yet been constructed and this situation can be avoided.
