STAFF COMMENTS: The rear setback of 15' is to ensure adequate
separation of dwellings and to ensure adequate light, air, and
convenience of access.
The building permit for this house shows a 15' setback for the rear
of the house in question here, and the permit is for a 40' X 30'
structure. The house as built is approximately 40' X 40' in terms
of its squared -off footprint and comes to within 10.7' of the rear
lot line. The size and shape of the house built does not appear to
have been possible to fit "into the available building area, even if
it was located by a surveyor. So it appears that the permit
applicant was simply not as careful as he should have been in
determining what size house could be placed there.

Staff has learned that the applicant did provide verbal assurances
to both the Building Official and the Zoning Administrator that the
setbacks would be carefully adhered to, with a certified surveyor
locating all the structures in the subdivision, since the zero -lot -
line subdivision requires very careful siting. The applicant
should address why this was not done in this case.
The County did approve the footer inspection for this structure.
Still, the owner/builder is responsible for ensuring that proper
setbacks are provided. The —building inspector --wa_s not _ =able ` t-0-- s%
de`termirie the -exact -location_of--the.._xe.ar_ lot_
There is a minimal portion of the open _space, -_parcel behind this
- ------------
house that is not wooded, so the house does impact the portion of
open space that is most--1-ikely to -be used__by_other residents.
In light of the shortcomings on the applicant's part in this case,
and in light of the State guidelines indicating that self-inflicted
hardships are not to be relieved by means of a variance, as well as
the potential impact on the useful open space, staff cannot support
this variance request.

being a portion of that certain 39.6054 acre parcel conveyed to LE.J.P.
Corporation, a Virginia Corporation, by Deed dated March 2, 1990, from
Robert J. Snyder, by M. Elizabeth Sargent, his Attorney -in -Fact, and of record
in the aforesaid Clerk's Office in Deed Book 740 at Page 515; and by Deed
of Correction dated the 6th day of September, 1991, and of record in the
