Applicant is having a problem selling the house since title insurance cannot be secured. STAFF COMMENTS: The side setback of 10' is to ensure adequate separation of dwellings and to ensure adequate light, air, and convenience of access. The building permit for this house shows a 10' side setback for the side of the house in question here. As placed, the house comes to within 7.7' of the lot line. It appears the builder was simply not as careful as he should have been in locating the house. However, the County did issue a Certificate of Occupancy for the structure, based on a private footer inspection. Still, the owner/builder is responsible for ensuring that proper setbacks are provided. The house is noticeably close to the side lot line and has a slight crowding effect on the general character of the neighborhood. The applicant has not shown the distance to the structure on the adjoining property, but there does not appear to be enough room for correcting this violation with a boundary line adjustment. Since the applicant presumably acquired the house in good faith, unaware of the violation, it may be unreasonable to impose on her the substantial cost of relocating the structure. However, the applicant should address whether there is title insurance currently and what options such insurance would provide if the variance were not granted.
