REASON FOR VARIANCE: The applicant states that the reason for the
variance is to bring the property into conformance with deed
restrictions or county setback restrictions.
STAFF COMMENTS: The side set 'back of 10' is to ensure adequate
separation of dwellings and to ensure adequate light, air, and
convenience of access.
The building permit for this house shows an 11' side setback for
the side of the house in question here. As placed, the house comes
to within 9.11. Building inspection records indicate that a
potential setback problem was identified at the footer inspection
stage and the builder was advised to ensure the proper side setback
was provided. It appears that the builder proceeded without doing
SO.
The house is noticeably close to the side lot line and has a slight
crowding effect on the general character of the neighborhood. The
house on the adjoining property is less than 20' away, according to

the applicant's drawing.
The applicant has provided no comments as to a hardship related to
the physical conditions on the property that would justify this
variance.
Staff sees no justification for the granting of this variance. The
requirements of the Code of Virginia for the granting of a variance
have not been met.
STAFF RECOMMENDATIONS: Denial, based on lack of justification.

Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick County
officials to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed at the front property line at least
