This letter is to confirm action taken by the Frederick County Board of Zoning Appeals at their
meeting of June 15, 1993.
Variance application #013-93 of Paramount Termite Control Co., Inc., was approved for the
distance buffers to be reduced to allow the new building to be within 15' of the east side of the
property and the driveway and parking area to be within the 25' inactive portion of the distance
buffer. Also approved was the reduction of the landscaped easement from 10' to 5' along the
eastern edge of the parking area and from 10' to 8' along the existing brick garage. The Board
also approved the elimination of the 6' high opaque fence requirement.
This property is located on the north side of Route 7 (Berryville Pike), in the Stonewall District,
and is identified as PIN 55B-A-4.

a zoning variance to not require fencing and additional landscaping.
Considering the facts that the proposed building will enhance the

and not a retail business. The only traffic in their lot will be its
employees.

VARIANCE: A reduction of the required distance and landscaping
buffers from the residential uses on both sides of the business.
REASON FOR VARIANCE: Exceptional narrowness of property prohibits
installation of full buffering.
STAFF COMMENTS: The distance and landscape buffers are intended to
mitigate the impacts of incompatible development on adjoining parcels.
The buffer required between B-2 property being developed and RP or RA
property used for residential purposes is 50' if a full screen is
provided. The full screen consists of a 6' high fence and a 10' fully
landscaped easement. 1,25' of the buffer area is supposed to be
inactive, which means that parking, -and driveways are not allowed
within 25' of the side property lines.
The subject property is approximately 130' wide. If a full distance
buffer were placed on both sides, only about 30' in the middle of the
parcel could have a building on it, and parking and driveways would
have to be on the middle 80' of the parcel. Although that does not
make the parcel unusable, it does seriously limit the use of the
property. There may well be a reasonable basis for relaxing the
distance buffer requirement on the property.
In terms of the screening requirement, the proposed development leaves
room for the required 10' landscaped easement and fence with the
exception of the eastern edge of the proposed parking area and the
existing brick garage. The eastern edge of the parking area would be
5' from the property line and the existing brick garage is 8' from the
property line. The applicant would provide the 10' landscaped
easement along both sides of the property, but is requesting a
variance to have only a 5' easement along the parking area and an 8'
easement along the garage. The applicant is also requesting a
variance from the fence requirement for both sides.
In light of the design requirements for the driveway and parking lot,
it appears reasonable to allow a reduction in the normal distance
buffer so that the driveway and parking area can be placed within the
inactive portion of the buffer. Therefore, it would be reasonable to
allow a variance to have only a 5' easement along the parking area and
an 8' easement along the garage. However, there is no hardship basis
for relaxing the fence requirement. If the distance buffers were
reduced, a fence would be more necessary to meet the intent of the
buffer requirements.
STAFF RECOMMENDATIONS: Approval for distance buffers to be reduced
to allow the new building to be within 15' of the east side of the
property, and the driveway and parking area to be within the 25,
inactive portion of the distance buffer as shown on the attached site
plan. Also, approval for the 10' landscaped easement to be reduced
to 5' along the eastern edge of the parking area and to 8' along the
existing brick garage, as shown on the attached plan. Disapproval for
the reduction of the screen requirement so as not to include a V high
opaque fence, on the basis of lack of hardship.
