their meeting of May 18, 1993.
Your application #012-93 was approved for a 6" side yard variance for an existing building
addition. This property is located on Route 11, south of the Middletown Corporate Limits,
in the Back Creek Magisterial District and is identified as GPIN 90-A-58C.
Please be aware that there is a 30-day time period during which this decision may be

REASON FOR VARIANCE: Extraordinary survey/layout error.
STAFF COMMENTS: The 25' setback requirement is to ensure adequate
space between light industrial facilities and surrounding uses.
In this case a small portion of the back part of the building was
mistakenly located 24'-6" from the side property line. The setback
violation is very minor and has no effect on the adequacy of the
space separating this facility from surrounding uses.
While the technical requirement for an undue hardship is not met
here, there is a reasonable basis for granting the variance on the
basis of its very small degree of violation and the unlikelihood
that any surrounding properties would be adversely affected in any
way.

I (we), the undersigned, do hereby respectfully make
application, and petition the Frederick County Board of Zoning
Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick County
officials to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed at the front property line at least
seven (7) days prior to the BZA public hearing and maintained so as
to be visible from the road or right-of-way until the hearing.
