STAFF COMMENTS: The perimeter setback requirement is to ensure adequate separation between different residential developments. Because the proposed deck would be attached to the house, it is considered part of the house and subject to the 50' setback requirement. The applicant's claim of exceptional shallowness is not consistent with the fact that all of the neighboring lots have the same depth as this lot. Although there are decks attached to some of the neighboring townhouses which violate the setback requirement, those decks were apparently constructed without building permits and variances and are therefore illegal. They have been reported to the County's Permits and Inspections Department for investigation. The applicant has a reasonable alternative to a deck in that a ground level patio could be constructed which is not subject to the 9 0 setback requirement. In light of the lack of demonstrated hardship and the alternatives available, there does not seem to be a reasonable basis for granting a variance.
