VARIANCE: One acre variance from five -acre minimum lot size in the
RA district.
REASON FOR VARIANCE: The owners of the neighboring lot wish to
pruchase a portion of the applicant's property because their lot is
low and wet in the front. This variance would allow the
neighboring lot more buildable area.
STAFF COMMENTS: The five acre minimum lot size in this district is
to maintain the rural character of the district and ensure that
each lot has reasonable space for a septic system.
This variance would not be likely -to impact the general character
of the district or general area, since it does not increase the
number of lots or allow for dwellings to be placed any closer to
each other..
Although there is no proof of undue hardship here, since it has not
been demonstrated that the neighboring lot would be unbuildable
unless this variance were granted, there may be a reasonable basis
for granting the variance. It does not appear that decreasing the
size of this lot will adversely impact the ability to have adequate
on -site septic disposal.
STAFF RECOMMENDATIONS: Approval.

application and petition the Frederick County Board of Zoning
Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick Co. officials
to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed at the front property line at least
seven (7) days prior to the BZA public hearing and maintained so
as to be visible from the road or right-of-way until the hearing.
