REASON FOR VARIANCE: The house, built in 1987, was built in violation of the required side setback. Applicants state that they were not aware of the violation until they pursued refinancing the property. STAFF COMMENTS: The side setback of 10' is to ensure adequate separtation of dwellings and to ensure adequate light, air, and convenience of access. The building permit for this house shows a 15' side setback for the side of the house in question here. As placed, the house comes to within 6.1' of the lot line. It appears the builder was simply not as careful as he should have been in locating the house. However, the County did issue a Certificate of Occupancy for the structure. The house is noticably close to the side lot line and has a slight crowding effect on the general character of the neighborhood. Since the applicants presumably acquired the house in good faith, having no reason to believe this violation existed, it may be unreasonable to impose on them the substantial cost of relocating the structure. However, the applicants should address whether the possibility of a boundary line adjustment has been checked into. Such an adjustment would help ensure that adequate separation from 0 0 the structure on the adjoining lot is maintained.
