It appears that the builder was simply not as careful as he should have been in placing the building on the property. The width, depth, size and shape of the lot is sufficient to accommodate the building, so there is not much reason for needing to adjust the building location. The Code of Virginia requires that variances be based on "undue hardship" and the state's guidelines for evaluating "undue hardship" stipulate that a self-imposed condition, such as improper placement of a structure on a lot, does not constitute an "undue hardship."
