Variance application #005-90 was approved for a 8' front side yard
and a 5' rear yard setback variance for a one car attached garage.

Village, across from Bass Hoover Elementary School and is

STAFF COMMENTS: This was originally scheduled for BZA
consideration in May for a front side yard variance but was tabled
and resubmitted for BZA consideration in June for both a front side
yard variance and a rear yard variance for an attached two car
garage. This item was tabled at the June meeting for
reconsideration of the garage size.
The applicant is now proposing a 16' x 24' garage addition,
requiring an 8' front side yard variance (instead of 9' previously
requested) and a 5' rear yard variance (instead of 121- 4"
previously requested). This appears to have substantially less
potential to adversely affect the neighborhood than the previous
proposal.

Dear Jerry:
Please find enclosed a copy of the BZA application that you
previously filed and a new application. Please be advised that we
must receive the new application not later than. May 29, 1990 in
order to go before the June 19th meeting.
Your new application should request a side yard variance of 9 feet
and a rear yard of 12 feet 4 inches. The short side of a corner
lot is considered the front so that makes it easy to determine what
the rear yard is. I
If I contributed to the confusion with the problem in getting this
straightened out I apologize.

.same property conveyed to Randolph It. Cornwell and
Beatrice D. McDonald (f/k/a Beatrice D. Cornwall), by
that certain deed dated October 15, 1985, from .1 & J
Builders, Inc., of record in the aforesaid Clerk's
Office in Deed Book 603, at Page 419. Reference is
made to the aforesaid instruments for a more
particular description of the property herein

The female Grantor joins in this Deed for purposes of
releasing any and all property rights in and to the subject
realty including, but not limited to her contingent right of
dower and any and all other applicable rights affecting the same

This conveyance is made subject to a certain Deed of Trust
from Randolph-11. Cornwell and Beatrice D. Cornwell, who was then

Clerk of the Circuit Court of Frederick County, Virginia. In Deed
[look 603, at Page 422 and a corrected Deed of Trust from Randolph
If. Cornwell and Beatrice D. Cornwell, who was then his wife, to
Commonwealth Abstract Corp.. et al, Trustees, dated the 4th day
of December, 1985, of record in the aforesaid Clerk's Office in
Deed Book 607, at Page 50, securing,a note of Randolph II.
Cornwell and Beatrice D. Cornwell, dated October 15, 1985, in the
original amount of Fifty -Two Thousand Dollars ($52,000.00),
together with interest thereon on the unpaid balance nntit paid,
payable to the order of First American Bank of Virginia of
Winchester, Virginia, or order, and as part of the consideration
for this conveyance the party of the second part assumes the
balance of $ 5.1,482.40 as of 'MaX1 , 1988, due on said
note. The party of the second part hereby covenant and agree to
pay the aforesaid note in accordance, with.its'terms and the terms
of the aforesaid Deed of Trust and corrected Deed of 'Trust, as
evidenced by their signing this Deed.
First American Batik of Virginia, holder of the hereinabove
described note executes this Deed of Assumption for the purpose
of evidencing its knowledge of and consent to the hereindescribed
assumption.
Except as noted above, the Grantors covenant that they have
a right to convey said property to the Grantees; that they have
done no other acts to encumber said property; that they will
execute such further assurances of said property as may be
requisite; that they are seized in fee.simple of the property
conveyed; and that the Grantees'shall have quiet possession of
said property, free from all encumbrances.
WHEREAS, the Grantors of the aforesaid Deed of Trust and
corrected Deed of Trust have requested that Randolph H. Cornwell
be released of and from any and all personal liability by First
American Bank of Virginia for the payment of the note secured by
the aforesaid Deed of Trust and corrected Deed of Trust.
NOW, THEREFORE, in consideration of the premises, the First
American Bank of Virginia does hereby release Randolph If.
Cornwell from and of any and all personal liability for payment
of the note secured by the aforesaid Deed of Trust dated the 15th
day of October, 1985, and corrected Deed'of Trust dated the 4th
day of December. 1985, and further covenants that it will not in
any manner or at any time proceed against said Randolph If.
Cornwell for the payment of a•ny part of the principal or interest
