13. The proposed addition will provide for expansion of
telephone service to accommodate growth in Frederick County's
population into the next century. This is an essential ser-
vice which the Owner is performing. The form of the proposed
addition is the most efficient and practical for the size and
location of the equipment which C&P proposes to install. The
variance being requested affects 8'-0" at the east end (front)
of the addition.
Construction beyond the north end of the proposed addition
is not practical as it would require relocation of the pump
and tank for the _building's septic system. Considerable grading
would be required in. this area and the lower half of the ex-
terior walls would have to be constucted to act as retaining
wall. This work will be expensive, considering the rather mo-
dest construction being proposed.
Extending the existing building to the west is not prac-
tical due to the location of an underground diesel fuel tank
adjacent to the building, that would have to be relocated if
construction took place in this area. The toilet and emergency
generator in the existing building would also have to be re-
located.
Building further to the east of the existing building is
limited by the 15.0' side yard setback. The northeast corner
of the existing building is 35.3' from the side property Line,
Leaving a building area 20.3' wide. If the full 20.3' were
employed, an addition 20.3' x 30.0' would be required to dup-
licate the 600 square footage of the addition now being pro-
posed. It appears the front wall of an addition 20.3' x 30.0'
would also exceed the 60.0' setback.
To provide the Owner with the necessary square footage,
some overlap of the 60.0' set back seems unavoidable.

parties of the first part, herein called Grantors; and the Chesapeake Zz
Potomac Telephone Company of Virginia, party of the second part, herein
called Grantee.
WITNESSETH: That for and in consideration of the sum of Ten
Dollars ($10.00) and other valuable consideration, the receipt of all of
which is hereby acknowledged, the Grantors do hereby grant, sell and
convey, with General. Warranty and English Covenants of. Title unto the
Grantee in fee simple absolutely all of that certain tract --or parcel of
land containing 70, 000 square feet lying and being situate in Gainesboro
Magisterial District, Frederick County, Virginia, along the 'North side of
U.S. Route 522, near Cross Junction and described by metes and bounds
