REASON FOR VARIANCE - In 1972 the septic system was approved and installed 90'
from the road. Because in 1973 the law was changed, a variance is needed. The
trailer is 12' wide; I need to be a minimum of 10' from the distribution box.
BACKGROUND INFORMATION - The appplicant wishes to place a mobile home 70' from the
center of Route 671. 80' is required from the center of Route 671, therefore, a
10' front yard variance is required.
STAFF COMMENT - The septic system has been installed and approved. The mobile
home is to be temporary until the applicant builds a house.

DEED I
THIS DEED, made and dated this day of 1988, by and
between ROBERT F. GRAY and MAXINE B. GRAY, his wit , parties of the first part,
hereinafter called the Grantors, and MICHAEL S. HUFFMAN, and ANN BAILEY HUFF�tAW,
his wife, parties of the second part, hereinafter called the Grantees.
WITNESSETH: That for and in consideration of the sum of ten dollars
($10.00), cash in hand paid, and other good and valuable consideration, the
receipt of which is hereby acknowledged, the Grantors do hereby grant, sell, and
convey with General Warranty of Title, in fee simple, unto the Grantees, as
tenants by the entirety, with common law right of survivorship, it being intended
that the part of the one first dying should then belong to the other, his or her
heirs and assigns, all of that certain lot or parcel of land, together with all
the improvements thereon and the appurtenances there -unto belonging, lying and
being situate in Frederick County, Virginia, and being more particularly
described as follow:
All that certain lot or parcel of land lying and being situate
approximately seven (7) miles North of Gainesboro, Virginia, in
Gainesboro Magisterial District, in Frederick County, Virginia,
containing four (4) acres, more or less, according to the Plat and
Survey of Clinton L. Ritter, C.L.S., dated July, 1972, herein
identified as Parcel 3A, Ritter Mountain, Section III, and being
the same real property which the Grantors herein acquired by Deed
dated the 14th day of October, 1978, from Clinton L. Ritter and
Peggy L. Ritter, his wife, of record in the Office of the Clerk of
the Circuit Court of Frederick County, Virginia, in Heed Rook 500,
at Page 441 to which reference is hereby made for a further and
more particular description of the realty hereby conveyed.
This conveyance is made subject to all restrictions, easements, and
building lines of record, if any, affecting the aforesaid realty and made subject
to the following restrictions incorporated herein:
1. No parcel or parcels of the real estate hereby conveyed by this Deed
may be subdivided into lots of less than three (3) acres.
2. The real estate hereby conveyed by this instrument may be used for
residential or recreational purposes only.
3. Any structure constructed upon the property hereby conveyed must

contain not less than 800 square feet of floor space.
4. Restriction against any house trailers or mobile homes which are
placed upon the premises for the purpose of constituting a permanent structure.
The Grantors do also grant and convey unto the Grantees an easement and
right of way over all existing roadways, being 30 feet in width, in Ritter
Motintain, Section III, to be used in common with the Grantors, their heirs and
assigns, for the purpose of ingress and egress to and from State Highway No. 671.
The Grantors covenant that they have a good right to convey said property
to the Grantees, that the Grantees shall have quiet and peaceable possession of
the said property, free from all liens and encumbrances, except as above noted,
and that the Grantors will grant such further assurances of title as may be
requisite.
