their meeting of August 16, 1988:
Approval of Variance Request #014-88 of Hamilton -Stafford Homes for a 6' 1" front
yard variance for an attached two -car garage. This property is located at the
intersection on Dogwood Road in Shenandoah Hills, Section 2, Lot. 95, in the
Stonewall Magisterial District.

REASON FOR VARIANCE - The shape of the lot in relationship to the state right-of-
way hampered the placement of a normal structure on the lot in line with the
existing properties.
BACKGROUND INFORMATION - The applicant has constructed a new home with an attached
22' x24' garage. The garage portion (on the west side of this structure) is
located 18' 9" from the front property line. A 25' setback is required,
therefore, a 6' 1" variance is required.
STAFF COMMENT - The house and attached garage are constructed and are ready for
occupancy. A permit was approved and the structure'was inspected. When the
property was surveyed, it was discovered that.an error had been made after the
permit was granted.

Hamilton -Stafford Homes built the house and garage in question under the belief
that the front setback was 15', based on incorrect interpretation of the
enclosed information (plat of Shenandoah Hills, building permit application
and footer inspection). The final plat of Section 2, Wilkin's Shenandoah
Hills as recorded in Deed Book 285, Page 86, mistakenly shows the front yard
setback on the north side of Dogwood Road as 15'. Based on this information
Hamilton -Stafford Homes applied for and was granted a building permit by the
Frederick County Building and Planning Department (number 15124) with the
front yard setback shown as 18'.
In accordance with the Virginia uniform building code the footers to the house
and garage were inspected on June 16, 1987 and passed including minimum setback
requirements. Along with the above mentioned errors, Hamilton -Stafford Homes
had the lot corners located by Dove and Associates, licensed surveyors, and
the house and garage corners staked by Buckley-Lages, Inc.
Hamilton -Stafford Homes has been building new homes in Frederick County for
five years and this is our first request for a variance. We feel we made
every effort to comply with the zoning ordinance. We are under contract to
sell the property and it would be a severe financial hardship to eliminate
the violation. Furthermore, the violation is screened from the adjoining
property and due to the placement of the road in the right of way the structure
does not distract from the street line.
