located on solid ground (existing) rather than fill. No other suitable building
site. Approved septic system,is installed. Property across road unsuitable for
any structure due to severe drop-off. Adjoining property to the north is shielded
by trees and shrubs. No other structures nearby.
BACKGROUND INFORMATION - The applicant wishes to construct a single-family
dwelling 60' from the center of Route 641. Route 641 has a 40' right-of-way,
requiring the dwelling to be 80' from the center of the right-of-way.

by and between C. WILLIAM DICK and JEANIE L. DICK, being one and
the same as GEANIE L. DICK, divorced,. party of the first part,
hereinafter called the Grantors, and C. William Dick, Divorced,
party of the second part, hereinafter called the Grantee.
WITNESSETH: that for and in consideration of the sum of
Ten Dollars ($10.00) cash in hand paid, and other good and
valuable consideration, the receipt of which is hereby
acknowledged, the Grantors do hereby grant and convey with genera
warranty of title unto the Grantee, in fee simple, all of that
certain lot or parcel of land together with the improvements
thereon and the appurtenances thereunto belonging, lying and'''
being situate near Ninevah, Virginia, on the eastern side of
Virginia secondary Highway No. 641, lying mostly in Opequon
Magisterial District,•.Frederick County, Virginia, and a small
portion lying in North River Magisterial District, Warren County,
Virginia, and containing 20.0004 acres, more or less, as
described on that certain plat of survey drawn by Trico Associate
Inc., dated September 5, 1974, attached to the hereinafter
mentioned deed, and being the same land conveyed to C. William
Dick and Geanie L. Dick, his wife, by deed of Melco, Inc., a
Virginia Corporation, dated May 15, 1975, and recorded in the
Office of the Clerk of the Circuit Court of Frederick County
in Deed Book 444 at page 274 and in the Office of the Clerk
of the Circuit Court of 'Warren County.
This conveyance is made subject to all easements, rights
of way and restrictions of record affecting the subject property.
This deed is made and accepted subject to that certain
indebtedness with Valley.Mortgage Company in the face amount
of $36,000.00 secured by a Deed of Trust of record in the office

of the Clerk 'bf the Circuit Court of Frederick County, Virginia
of record in Deed Book 435 at page 662.
The Grantors do hereby covenant that they have the right
to convey to the Grantee; that the Grantee shall have quiet

liens and encumbrances; and they will grant such further
assurances of title as may be requisite.
This deed is executed pursuant to a written separation
agreement between the parties hereto.
